Service Agreement of GE imagine

Welcome to GE imagine!

Before accepting the Agreement, you are supposed to thoroughly read all contents of the Agreement, and fully know its terms, especially restrictive clauses or exceptions. Restrictive clauses or exceptions are bold or highlighted in other forms to catch your attention. In case of any doubt for the terms of the Agreement, please contact relevant business department of GE imagine. You are not allowed to use the service before you have read and accepted all terms of the Agreement, relevant agreements and rules, etc. Once you select "agree and submit the Agreement" (see registration page for detailed wordings) and complete the registration procedure, or you use the service in any form, it will be deemed that you have read and agreed with the restriction of the Agreement and rules above. In case of any breach of the Agreement, GE imagine has the right to unilaterally restrict, suspend or terminate the service for you, and has the right to investigate your relevant responsibilities.

The Service Agreement (hereinafter referred to as "the Agreement") is signed by you and GE imagine. It includes (but not limited to) GE imagine Privacy Policy and other contents. In case of change, GE imagine will announce by means of the licensed software sending a message without further notification. Upon announcement, the changed agreement and rules become a part to the Agreement automatically, without further notification to you for your consent. In case of objection to such relevant changes, stop use GE imagine's service; if you keep using it, it will deemed as that you hold no objections against the changed rules and agree to abide by them.



I. Definitions of Terms

  • 1.1 Licensed software refers to software system developed by GE imagine, downloaded and installed and applied in specified system mobile terminals.
  • 1.2 Services refer to services provided for you by GE imagine and its suppliers. You can use such services on the mobile terminal with the licensed software.

II. Service

  • 2.1 GE imagine offers you intelligent life equipment management services, based on which you can access the intelligent terminals on GE imagine and its suppliers' smart platform through the GE imagine Control, and realize interlinkage among intelligent equipment. Service contents include intelligent equipment management, scene interlinkage and analysis report, etc. Such functions may be optimized or modified according to changes of users' demands or judgment of service supplier, and service supply may be suspended due to regular and irregular maintenance.

III. Scope of Service

  • 3.1 GE imagine grants you with the right to use the product based on this software.
  • 3.2 You are prohibited to license, sell, lease, transfer, issue the product in any form, or use the product for other commercial purpose. 3.2 Due to limitations on software adaptation platform and terminals, you can only use the licensed software in the authorized system platform and terminal; if you install the licensed software on other terminal equipment, it may damage your hardware or software function.
  • 3.3 You acknowledge that the licensed software can only be used for non-commercial purpose and installation, application and running of the licensed software is prohibited. If such commercial operation is necessary, prior written authorization and permission from GE imagine shall be obtained.
  • 3.4 GE imagine and its suppliers may change, upgrade or transfer the licensed software or relevant functions from time to time, and may add new functions or services in the licensed software system. If no separate agreements are accompanied with the aforesaid new functions or services, you are entitled to the corresponding functions and services, which is also subject to the Agreement.
  • 3.5 You shall be responsible for the accuracy, reliability, integrity and legality of input data and legality of the way in which you obtain the data, and shall back up data and information from time to time. You shall bear all risks for damage and loss of such information.
  • 3.6 You shall properly keep your account number and password. In case of any safety loophole for your account (including but not limited to divulgence of user password), you shall notify GE imagine in time, and GE imagine will assist you in taking relevant measures. Otherwise, all behaviors related to your account shall be assumed by you and you will bear all responsibilities.

IV. A Third Party

  • 4.1 You acknowledge that certain service of GE imagine and its suppliers is based on software or services provided by a third party. Such service is set to facilitate your application and necessary legal authorization is obtained from the third party.
  • 4.2 The product includes certain information and services of the third party. GE imagine and its suppliers neither controls nor bears responsibility for information and services of the third party.
  • 4.3 You acknowledge that GE imagine and its suppliers cannot guarantee that the licensed software always uses or contains such services, or that other software provided by the same third party will be used in future. Likewise, it may use similar services supplied by another third party. Upon application, the aforesaid corresponding software or services are subject to this Agreement.

V. Service Application Standard

  • 5.1 You shall use the licensed software in a normal manner. The following ways are in breach of the application standard:
    • 1) Issue or share computer virus, worms, malicious codes, or software that deliberately damages or changes computer system or data;
    • 2) Collect information or data of other users without authorization, for example, email address and the like;
    • 3) Maliciously use the product in an automatic way, causing over load to the server, or interfere with or damage web server and network links in other forms.
    • 4) Attempt to visit server data or communication data of the product without authorization;
    • 5) Interfere with or damage the production application by other users.
  • 5.2 You understand and agree that:
    • 1) GE imagine will determine whether or not you are involved in violation of standards above, and suspend or terminate your application license according to determination results or take other restrictions according to agreements.
    • 2) GE imagine will directly delete information in breach of laws, or infringing others' legal rights, or in breach of the Agreement issued by you when using the licensed software.
    • 3) If a third party suffers from damage due to your breach of application standards, you shall independently bear legal responsibility in your name, and protect and indemnify GE imagine from losses or additional expenses generated therefrom. Otherwise, GE imagine has the right to claim compensation.
    • 4) If GE imagine and its suppliers suffers from any loss due to your breach of relevant laws or the Agreement, you shall compensate GE imagine and its suppliers for losses and (or) expenses generated therefrom.

VI. Information Content Standard

  • 6.1 You promise that you will not conduct any act in breach of laws or improper behaviors by using the service, such act and behavior include (but not limited to):
    • 6.1.1 Uploading, transferring or sharing information containing one of the following contents:
      • 1) Opposing the basic principles determined in the Constitution;
      • 2) Endangering state safety, disclosing state secret, subverting state power and sabotaging state unity;
      • 3) Damaging state honor and benefit;
      • 4) Inciting national hatred and discrimination and sabotaging national unity;
      • 5) Destroying religious policy of the state and advocating heresy and feudalistic superstition;
      • 6) Spreading rumors, disturbing social order and destroying social stability;
      • 7) Spreading obscenity, porn, gambling, violence , murder and terror or abetting a crime;
      • 8) Insulting or slandering others and infringing on the legal rights and interests of others;
      • 9) Containing contents of sham, defraudation, harm, threat, infringement to others' privacy, harassment, infringement, slander, coarseness, indecency, or morally repulsive contents;
      • 10) Containing other contents restricted or forbidden by applicable laws, regulations, rules, provisions and other legal standards.

VII. Private Policy and Data

  • 7.1 It is crucial for GE imagine to protect your personal information. GE imagine prepares GE imagine Privacy Policy , in which contents related to ownership and protection of intellectual property, collection, use, share, storage and protection, etc. of your information are disclosed. You are suggested to thoroughly read GE imagine Privacy Policy.

VIII. Exception Clauses

  • 8.1 Unless otherwise specified in laws and regulations, GE imagine will do its best to ensure the security, validity, accuracy and reliability of the licensed software and technologies and information involved, but GE imagine is unable to guarantee the same due to restriction by available technologies nowadays.
  • 8.2 You understand that GE imagine will not assume responsibility for direct or indirect losses caused by force majeure and default of a third party.
  • 8.3 You shall be responsible for personnel injury or incidental or indirectly injury caused by or related to one of the following accidents: 1) A third party uses the licensed software or changes your data without permission; 2) Expenses and losses produced by using the licensed software; 3) Your misunderstanding of the licensed software; 4) Other losses related to licensed software caused by reasons not attributable to GE imagine.
  • 8.4 Any other licensed software-derived software not developed and released by GE imagine or the development and release are not granted by GE imagine is illegal software. Downloading, installing and using such software may cause unpredictable risks. GE imagine shall be free from legal responsibilities and disputes generated therein and GE imagine shall have the right to suspend or terminate application license and/or other all services.
  • 8.5 You have been informed of that the usage of GE imagine and its supplier's smart platform involves in Internet service, which may be affected by unstable factors in all links. Although GE imagine has taken safeguard measures, the service may be suspended, terminated, delayed, suffered from application restriction or application failure due to inherent defects of Internet and e-communication as well as factors beyond reasonable control of any party to the Agreement (including but not limited to fire, flood, terrorist attack, pestilence, natural disasters, riot, terminal virus, hacker attack, network fault and terminal fault). You hereby agree to bear foregoing risks and agree that GE imagine is free from any responsibility when normal running of services are influenced by the occurrence of foregoing risks.

IX. Agreement Termination and Breach of Agreement

  • 9.1 You should understand that you shall use the licensed software according to authorization scope, respect intellectual property of software and contents contained in the software, and perform obligations according to the Agreement when using GE imagine's services. GE imagine will terminate the application license if you are in material breach of the Agreement.
  • 9.2 Your application of the software relies on supporting services supplied by GE imagine's related companies. Breach of terms, agreements, rules, annunciation and other relevant regulations of GE imagine and its related companies may cause failure in normal usage of licensed software, in which case, GE imagine shall be entitled to terminate the application license, or take measures to restrain your application license or other rights and interests controlled by GE imagine as agreed in the Agreement, including suspension or termination of your application license.
  • 9.3 In case of your breach of the Agreement or other agreements signed with GE imagine, GE imagine and its suppliers shall have the right to notify the related companies, requiring them to take restrictive measures to your rights and interests, including requiring related companies to suspend or terminate supplying part or whole services for you, and legally announce your breach of agreement on websites run or actually controlled by them.
  • 9.4 The licensed software is downloaded from the downloading platform and you shall abide by stipulations of the download platform, system platform and terminal manufacture on application ways and restrictions of the licensed software. If the above mentioned third party confirms that you are in breach of the agreement and GE imagine and its supplier's treatment is required, GE imagine may terminate your application license at the third party's request.
  • 9.5 When the application license terminates, you shall stop using the licensed software and destroy all copies.
  • 9.6 You must bear all compensation responsibilities if GE imagine and other users suffer from losses caused by your breach of terms in the Agreement.

X. Governing Laws and Severability

  • 10.1 Effectiveness, explanation, change, execution and dispute settlement of the Agreement are subject to laws of the People's Republic of China. If no relevant laws and regulations are available, reference to general international business practices and (or) industrial practices shall be made.
  • 10.2 Dispute arising from or in connection with the Agreement may be settled by you and GE imagine through friendly negotiation or submitted to People's Court of Brightlite Nominees P/L trading as Beacon Lighing where the Agreement is signed for adjudication.
  • 10.3 When any term of the Agreement is judged to be invalid by the People's Court, it will not influence the effectiveness of other terms or any part thereof, and you and GE imagine shall perform the valid terms in good faith.
  • 10.4 The Agreement is signed in Brightlite Nominees P/L trading as Beacon Lighing.




Dienstleistungsvereinbarung von GE imagine

Willkommen bei GE imagine!

Bevor Sie diese Vereinbarung annehmen, sollten Sie den gesamten Inhalt gründlich lesen und die Bedingungen vollständig kennen, insbesondere einschränkende Klauseln oder Ausnahmen. Einschränkende Klauseln oder Ausnahmen sind fettgedruckt oder auf andere Weisen hervorgehoben, um Ihre Aufmerksamkeit zu erregen. Bei Zweifeln zu den Bedingungen der Vereinbarung, wenden Sie sich bitte an die entsprechende Unternehmensabteilung von GE imagine. Sie dürfen nicht den Dienst verwenden, bevor Sie sämtliche Bestimmungen der Vereinbarung, relevante Vereinbarungen und Regeln usw. gelesen und akzeptiert haben. Sobald Sie "Einverstanden und Vereinbarung einreichen" (siehe Registrierungsseite für genauen Wortlaut) ausgewählt haben und den Registrierungsprozess abgeschlossen haben, oder wenn Sie den Dienst in irgendeiner Form verwenden, bedeutet dies, dass Sie die Beschränkung der Vereinbarung und Regeln oben gelesen haben und damit einverstanden sind. Im Falle eines Verstoßes gegen die Vereinbarung hat GE imagine das Recht, den Dienst für Sie einseitig zu beschränken, unterbrechen oder kündigen, sowie das Recht, Ihre relevanten Verantwortungen zu erforschen.

Die Dienstleistungsvereinbarung (im Folgenden als "die Vereinbarung") wird von Ihnen und GE imagine (im Folgenden "GE imagine") unterzeichnet. Sie umfasst (ist aber nicht darauf beschränkt) eine Datenschutzrichtlinie für die GE imagine und weiteren Inhalt. Bei einer Änderung wird GE imagine diese ohne weitere Benachrichtigung auf seiner Webseite ankündigen. Bei einer Ankündigung werden die geänderte Vereinbarung und Regeln automatisch Teil der Vereinbarung, ohne Ihre weitere Benachrichtigung für Ihr Einverständnis. Im Falle eines Einwandes gegen solche relevanten Änderungen, beenden Sie die Verwendung des Dienstes von GE imagine; sollten Sie diesen weiterhin benutzen, wird dies betrachtet, als wenn Sie keinen Einwand gegen die geänderten Regeln hätten und damit einverstanden wären, diese einzuhalten.



I. Begriffsdefinitionen

  • 1.1 Lizenzierte Software bedeutet ein von GE imagine entwickeltes Softwaresystem, aus der Plattform heruntergeladen und in bestimmten mobilen Systemterminals installiert und angewendet.
  • 1.2 Dienste bezieht sich auf Ihnen von GE imagine bereitgestellte Dienste. Sie können solche Dienste auf dem mobilen Terminal mit der lizenzierten Software verwenden.

II. Dienst

  • 2.1 GE imagine bietet Ihnen intelligente Gerätemanagementdienste, aufgrund welcher Sie auf das intelligente Terminal auf GE imagine und die Smartplattform des Lieferanten durch die GE imagine Control zugreifen und eine Verknüpfung zwischen intelligenter Ausrüstung vornehmen können. Die Dienstinhalte umfassen intelligente Geräteverwaltung, Szenenverknüpfung und Analysebericht usw. Solche Funktionen könnten optimiert oder entsprechend der Änderungen der Anfragen der Benutzer oder nach Ermessen des Dienstanbieters optimiert oder verändert werden und der gelieferte Dienst kann aufgrund von regulären und irregulären Wartungsarbeiten aufgehoben werden.

III. Umfang des Dienstes

  • 3.1 GE imagine gewährt Ihnen das Recht, das Produkt basierend auf dieser Software zu verwenden.
  • 3.2 Sie dürfen das Produkt in keiner Weise lizenzieren, verkaufen, leasen, übertragen oder herausgeben oder für einen anderen gewerblichen Zweck verwenden. 3.2 Aufgrund der Beschränkungen der Software-Anpassungsplattform und Terminals können Sie die lizenzierte Software nur in der befugten Systemplattform und Terminal verwenden; wenn Sie die lizenzierte Software auf einem anderen Terminalgerät verwenden, könnte dies Ihre Hardware oder Softwarefunktion beschädigen.
  • 3.3 Sie stimmen zu, dass die lizenzierte Software nur für nicht kommerzielle Zwecke verwendet werden kann und die Installation, Anwendung und der Betrieb der lizenzierten Software untersagt ist. Sollte eine solche gewerbliche Tätigkeit erforderlich sein, ist eine schriftliche Autorisierung und Erlaubnis von GE imagine einzuholen.
  • 3.4 GE imagine kann die lizenzierte Software oder relevante Funktionen von Zeit zu Zeit ändern, aktualisieren oder übertragen sowie neue Funktionen oder Dienstleistungen im lizenzierten Softwaresystem hinzufügen. Wenn keine getrennten Vereinbarungen mit den oben genannten neuen Funktionen oder Diensten einhergehen, sind Sie zu den entsprechenden Funktionen und Diensten berechtigt, welche auch der Vereinbarung unterliegen.
  • 3.5 Sie sind für die Genauigkeit, Zuverlässigkeit, Integrität und Rechtmäßigkeit der eingegebenen Daten und der Rechtmäßigkeit, mit der Sie die Daten erhalten, verantwortlich, und sollten von Zeit zu Zeit Sicherheitskopien der Daten und Informationen machen. Sie tragen sämtliche Risiken für Beschädigungen und Verlust solcher Informationen.
  • 3.6 Sie müssen Ihre Kontonummer und Ihr Passwort gut aufbewahren. Im Falle einer Sicherheitslücke für Ihr Konto (einschließlich, aber nicht beschränkt auf die Bekanntmachung des Benutzerpassworts) müssen Sie GE imagine zeitgerecht informieren und GE imagine wird Ihnen beim Ergreifen der relevanten Maßnahmen helfen. Ansonsten werden alle Verhaltensweisen in Bezug auf Ihr Konto von Ihnen übernommen und Sie werden die gesamte Verantwortung tragen.

IV. Eine Drittpartei

  • 4.1 Sie sind damit einverstanden, dass ein bestimmter Dienst von GE imagine auf Software oder Dienste von Drittparteien basiert. Ein solcher Dienst wird bereitgestellt, um Ihre Anwendung zu erleichtern und die notwendige gesetzliche Autorisierung wird von der Drittpartei eingeholt.
  • 4.2 Das Produkt enthält bestimmte Informationen und Dienste der Drittpartei. GE imagine hat weder die Kontrolle noch trägt es die Verantwortung für Informationen und Dienste der Drittpartei.
  • 4.3 Sie sind damit einverstanden, dass GE imagine nicht garantieren kann, dass die lizenzierte Software immer solche Dienste verwendet oder enthält oder dass eine andere von derselben Drittpartei bereitgestellte Software in Zukunft verwendet wird. Es kann ebenso ähnliche Dienste von einer anderen Drittpartei bereitstellen. Bei der Anwendung unterliegt die oben genannte entsprechende Software oder Dienste dieser Vereinbarung.

V. Dienst-Anwendungsstandard

  • 5.1 Sie müssen die lizenzierte Software auf normale Weise verwenden. Die folgenden Weisen widersprechen dem Anwendungsstandard:
    • 1) Computerviren, Würmer, bösartige Codes oder Software einführen oder teilen, die das Computersystem oder die Daten vorsätzlich beschädigen oder ändern;
    • 2) Informationen oder Daten von anderen Benutzern ohne Genehmigung erfassen, beispielsweise E-Mail-Adressen und ähnliches;
    • 3) Das Produkt in einer böswilligen Weise automatisch zu verwenden und dabei den Server überlasten oder den Webserver und die Netzwerklinks in anderer Weise zu stören oder zu beschädigen.
    • 4) Zu versuchen, Serverdaten oder Kommunikationsdaten des Produktes ohne Befugnis zu besuchen;
    • 5) Die Produktionsanwendung durch andere Benutzer zu stören oder zu beschädigen.
  • 5.2 Sie verstehen und sind damit einverstanden, dass:
    • 1) GE imagine bestimmen wird, ob Sie gegen die Standards oben verstoßen haben oder nicht, und Ihre Applikationslizenz aufzuheben oder zu kündigen entsprechend der Ergebnisse der Ermittlung oder je nach den Vereinbarungen andere Beschränkungen aufzuerlegen.
    • 2) GE imagine wird rechtswidrige Informationen oder Informationen, die die Rechtsansprüche anderer verletzen oder einen Verstoß gegen die von Ihnen angenommene Vereinbarung durch den Gebrauch der lizenzierten Software darstellen, direkt löschen.
    • 3) Wenn einer Drittpartei aufgrund Ihres Verstoßes gegen Anwendungsstandards Schaden zugefügt wird, werden Sie unabhängig in Ihrem Namen rechtliche Verantwortung tragen und GE imagine vor Verlusten oder zusätzlichen Unkosten daraus schadlos halten. Anderenfalls hat GE imagine das Recht auf Entschädigungsforderung.
    • 4) Wenn GE imagine irgendeinen Verlust aufgrund Ihres Verstoßes gegen relevante Gesetze oder die Vereinbarung erleidet, werden Sie GE imagine für die Verluste und (oder) daraus entstandenen Unkosten entschädigen.

VI. Informationsinhalt-Standard

  • 6.1 Sie erklären sich damit einverstanden, dass Sie durch den Gebrauch des Dienstes gegen keine Gesetze verstoßen und sich nicht unangemessen verhalten werden, solche Aktivitäten und Verhaltensweisen umfassen (sind aber nicht darauf beschränkt):
    • 6.1.1 Informationen hochladen, übertragen oder teilen, die einen der folgenden Inhalte enthalten:
      • 1) Inhalte, die in Widerspruch mit den Grundprinzipien der Verfassung stehen;
      • 2) Inhalte, die die Staatssicherheit gefährden, ein Staatsgeheimnis offen legen, die Staatsmacht untergraben und die staatliche Einheit sabotieren;
      • 3) Inhalte, die die Ehre und Anerkennung des Staates schädigen;
      • 4) Inhalte, die Hass gegen den Staat hervorrufen und die staatliche Einheit diskriminieren und sabotieren;
      • 5) Inhalte, die die Religionspolitik des Staates zerstören und Häresie und feudalistischen Aberglauben befürworten;
      • 6) Inhalte, die Gerüchte verbreiten, die soziale Ordnung stören und die soziale Stabilität zerstören;
      • 7) Inhalte, die Obszönität, Porno, Glücksspiel, Gewalt, Mord und Terror verbreiten oder ein Verbrechen begünstigen;
      • 8) Inhalte, die andere beleidigen oder lästern und die Rechtsansprüche und Interessen anderer verletzen;
      • 9) Inhalte, die vorgetäuschte, betrügerische, schädliche, bedrohliche Inhalte enthalten oder die die Privatsphäre anderer verletzen, oder belästigende, rechtsverletzende, verleumdende, vulgäre, unanständige oder moralisch widerwärtige Inhalte enthalten;
      • 10) Inhalte, die andere Inhalte enthalten, die nach geltendem Recht, Vorschriften, Regeln, Bestimmungen und sonstigen gesetzlichen Standards beschränkt oder verboten sind.

VII. Datenschutzerklärung und Daten

  • 7.1 Es ist für GE imagine wichtig, Ihre personenbezogenen Informationen zu schützen. GE imagine bereitet die Datenschutzrichtlinie der GE imagine vor, in der Inhalte bezüglich Eigentümerschaft und Schutz von intellektuellem Eigentum, Erfassung, Gebrauch, Preisgebung, Speicherung und Schutz usw. Ihrer Informationen enthalten sind. Wir empfehlen Ihnen, die Datenschutzrichtlinie der GE imagine sorgfältig zu lesen.

VIII. Ausnahmeklauseln

  • 8.1 Wenn nicht anderweitig in Gesetzen und Regelungen festgelegt, wird GE imagine sich alle Mühe geben, um die Sicherheit, Gültigkeit, Genauigkeit und Zuverlässigkeit der lizenzierten Software und Technologien und zugehörigen Informationen sicherzustellen, GE imagine ist jedoch nicht in der Lage, dasselbe zu garantieren, aufgrund der Beschränkungen der heutzutage verfügbaren Technologien.
  • 8.2 Sie verstehen, dass GE imagine nicht die Verantwortung für direkte oder indirekte Verluste, die durch höhere Gewalt und Versäumnis einer Drittpartei hervorgerufen werden, übernehmen wird.
  • 8.3 Sie sind verantwortlich für Personenschaden oder Nebenschaden oder indirekte Verletzungen, die durch einen der folgenden Unfälle hervorgerufen werden: 1) Eine Drittpartei verwendet die lizenzierte Software und ändert Ihre Daten ohne Erlaubnis; 2) Mit dem Gebrauch der lizenzierten Software verbundene Unkosten und Verluste; 3) Ihr Missverständnis über die lizenzierte Software; 4) Andere Verluste in Verbindung mit der lizenzierten Software mit einer Ursache, die nicht GE imagine zuzuschreiben ist.
  • 8.4 Sämtliche andere lizenzierte Software-abgeleitete Software, die nicht von GE imagine entwickelt und veröffentlicht wurde oder deren Entwicklung und Veröffentlichung nicht durch GE imagine genehmigt wurde, ist eine illegale Software. Eine solche Software herunterzuladen, zu installieren und zu verwenden kann unvorhersehbare Folgen haben. GE imagine ist von den gesetzlichen Verantwortungen und den daraus entstehenden Streitfällen befreit und GE imagine hat das Recht, die Lizenz der Anwendung und/oder alle Dienste aufzuheben oder zu kündigen.
  • 8.5 Sie wurden darüber informiert, dass der Gebrauch der GE imagine und die Smartplattform des Lieferanten einen Internetdienst einbezieht, welcher durch instabile Faktoren bei allen Links beeinflusst wird. Auch wenn GE imagine Sicherheitsmaßnahmen getroffen hat, könnte der Dienst unterbrochen, abgebrochen, verzögert, durch eine Beschränkung oder einen Fehler der Applikation aufgrund inhärenter Defekte des Internets und der E-Kommunikation, sowie durch Faktoren außerhalb der zumutbaren Kontrolle einer Partei der Vereinbarung (einschließlich, aber nicht beschränkt auf Brand, Flut, Terroranschlag, Seuche, Naturkatastrophen, Unruhe, Terminalvirus, Hackerangriff, Netzwerkfehler und Terminalfehler), beeinträchtigt werden. Sie übernehmen hiermit die vorstehenden Risiken und sind damit einverstanden, dass GE imagine von jeglicher Verantwortung befreit ist, wenn der normale Betrieb der Dienste durch Eintreten der folgenden Risiken beeinflusst wird.

IX. Kündigung der Vereinbarung und Verstoß gegen die Vereinbarung

  • 9.1 Sie müssen wissen, dass Sie die lizenzierte Software entsprechend des Berechtigungsumfangs verwenden, das geistige Eigentum von Software und der Inhalte in der Software respektieren und die Verpflichtungen entsprechend der Vereinbarung bei Verwendung der Dienste von GE imagine einhalten sollen. GE imagine wird die Lizenz der Applikation kündigen, wenn Sie schwerwiegend gegen die Vereinbarung verstoßen.
  • 9.2 Ihre Anwendung der Software ist auf unterstützende Dienste durch zugehörige Unternehmen von GE imagine angewiesen. Ein Verstoß gegen die Bedingungen, Vereinbarungen, Regeln, Ankündigung und sonstige relevanten Regelungen von GE imagine und seinen zugehörigen Unternehmen könnte einen Fehler im normalen Gebrauch der lizenzierten Software hervorrufen, in welchem Fall GE imagine dazu berechtigt ist, die Lizenz der Anwendung zu kündigen oder Maßnahmen zu ergreifen, um Ihre Lizenz für die Anwendung sowie andere Rechte und Interessen unter Kontrolle von GE imagine zu beschränken, wie in der Vereinbarung festgelegt, darunter die Aufhebung oder Kündigung Ihrer Lizenz für die Anwendung.
  • 9.3 Im Falle Ihres Verstoßes gegen die Vereinbarung oder andere mit GE imagine unterzeichneten Vereinbarungen wird GE imagine das Recht haben, die zugehörigen Unternehmen zu benachrichtigen und sie dazu aufzufordern, einschränkende Maßnahmen bezüglich Ihre Rechte und Interessen zu ergreifen, einschließlich zugehörige Unternehmen darum zu bitten, einen Teil oder die gesamten Dienste für Sie aufzuheben oder zu kündigen, und Ihren Verstoß auf Webseiten, die sie betreiben oder kontrollieren, gesetzlich bekannt zu machen.
  • 9.4 Die lizenzierte Software wird von der Download-Plattform heruntergeladen und Sie müssen sich an die Klauseln der Download-Plattform, System-Plattform und Terminalfertigung auf Anwendungsmethoden und Beschränkungen der lizenzierten Software halten. Wenn die oben genannte Drittpartei bestätigt, dass Sie gegen die Vereinbarung verstoßen haben und ein Verfahren durch GE imagine erforderlich ist, kann GE imagine Ihre Lizenz zu der Applikation auf Anfrage einer Drittpartei kündigen.
  • 9.5 Wenn die Lizenz der Anwendung gekündigt wird, müssen Sie die Verwendung der lizenzierten Software einstellen und sämtliche Kopien vernichten.
  • 9.6 Sie müssen sämtliche Verantwortung für Schadenersatz übernehmen, wenn GE imagine und andere Benutzer Verluste erleiden, die durch Ihren Verstoß gegen die Bedingungen der Vereinbarung verursacht wurden.

X. Geltende Gesetze und salvatorische Klausel

  • 10.1 Die Wirkung, Erklärung, Änderung, Durchsetzung und Streitschlichtung der Vereinbarung unterliegen den Gesetzen der Volksrepublik China. Wenn keine relevanten Gesetze und Regelungen verfügbar sind, ist auf die allgemeinen internationalen Geschäftspraktiken und (oder) industriellen Praktiken Bezug zu nehmen.
  • 10.2 Ein sich durch oder in Verbindung mit der Vereinbarung ergebender Streitfall kann durch Sie und GE imagine durch freundliche Verhandlungen geschlichtet werden oder dem Volksgerichtshof des Brightlite Nominees P/L trading as Beacon Lighing eingereicht werden, wo die Vereinbarung zur Beurteilung vorgelegt wird.
  • 10.3 Wenn eine Klausel durch den Gerichtshof als ungültig erachtet wird, wird dies nicht die Wirksamkeit der anderen Klauseln oder Teile davon beeinträchtigen und Sie und GE imagine sollten die gültigen Klauseln in gutem Glaube erfüllen.

I. Definiciones de términos

II. Servicio

  • 2.1 GE imagine ofrece servicios de gestión de equipos inteligentes, que permiten acceder al terminal inteligente en la GE imagine y la plataforma inteligente de sus proveedores a través de GE imagine Control y realizar la interconexión entre equipos inteligentes. Los contenidos del Servicio incluyen gestión de equipos inteligentes, interconexión de ámbitos e informes de análisis, etc. Estas funciones pueden optimizarse o modificarse de acuerdo con los cambios en los requisitos de los usuarios o de acuerdo con el criterio del proveedor de servicio, y el suministro del servicio puede suspenderse debido a tareas de mantenimiento programadas o no programadas.

III. Ámbito del servicio

  • 3.1 GE imagine concede al usuario el derecho de uso del producto basado en este software.
  • 3.2 Se prohíbe al usuario conceder una licencia, vender, alquilar, transferir, publicar el producto de cualquier forma o utilizar el producto para otro propósito comercial. 3.2 Debido a las limitaciones de la plataforma de adaptación del software y de los terminales, solo puede utilizar el software bajo licencia en la plataforma del sistema autorizada y en el terminal autorizado; si instala el software bajo licencia en otro equipo terminal, el funcionamiento de su hardware o software puede deteriorarse.
  • 3.3 El usuario acepta que el software bajo licencia solo puede utilizarse para fines no comerciales, y se prohíbe la instalación, aplicación y ejecución del software bajo licencia. Si dicho funcionamiento comercial resultara necesario, debe obtenerse la autorización previa por escrito de GE imagine.
  • 3.4 GE imagine puede modificar, actualizar o transferir el software bajo licencia o funciones relevantes del mismo periódicamente, y puede añadir nuevas funciones o servicios al sistema de software bajo licencia. Si ningún acuerdo independiente acompañara a las funciones o servicios mencionados anteriormente, el usuario tendrá derecho a las funciones y servicios correspondientes, que también estarán sujetos al Acuerdo.
  • 3.5 El usuario es responsable de la exactitud, fiabilidad, integridad y legalidad de los datos introducidos y de la legalidad de la forma de obtención de los datos, y realizará copias de seguridad periódicas de los datos y la información. El usuario asumirá todos los riesgos relacionados con los daños y la pérdida de dicha información.
  • 3.6 El usuario debe proteger debidamente su número de cuenta y contraseña. Si ocurriera alguna brecha de seguridad en relación con su cuenta (incluyendo, aunque sin limitación, la divulgación de la contraseña de usuario), deberá notificar el problema a GE imagine inmediatamente, y GE imagine prestará asistencia al usuario para adoptar las medidas correspondientes. IV. Un tercero

  • 4.1 El usuario acepta que parte del servicio de GE imagine se base en software o servicios proporcionados por un tercero, con el propósito de facilitar su aplicación. GE imagine dispone de la autorización legal necesaria del tercero.
  • 4.2 El producto incluye información y servicios concretos del tercero. GE imagine no controla ni asume la responsabilidad con respecto a la información y servicios del tercero.
  • 4.3 El usuario acepta que GE imagine no puede garantizar que el software bajo licencia utilice o incluya siempre dichos servicios, o que se utilice en el futuro otro software proporcionado por el mismo tercero. Asimismo, puede utilizar servicios similares suministrados por otro tercero. Tras su aplicación, el software o los servicios correspondientes mencionados están sujetos a este Acuerdo.

V. Norma de aplicación del servicio

  • 5.1 El usuario debe utilizar el software bajo licencia de forma normal. Las siguientes formas de uso incumplen la norma de aplicación:
    • 1) Propagar o compartir virus informáticos, gusanos, códigos maliciosos o software que dañe o cambie deliberadamente el sistema o los datos informáticos.
    • 2) Recopilar información o datos de otros usuarios sin autorización, por ejemplo dirección de correo electrónico e información similar.
    • 3) Utilizar maliciosamente el producto de una forma automatizada que provoque sobrecarga en el servidor o interfiera o cause otros daños en el servidor web y los enlaces de red.
    • 4) Tratar de visitar datos del servidor o datos de comunicación del producto sin autorización.
    • 5) Interferir o causar daños en la aplicación de producción de otros usuarios.
  • 5.2 El usuario comprende y acepta que:
    • 1) GE imagine determinará si el usuario está involucrado en violaciones de la norma de aplicación mencionadas anteriormente, y suspenderá o cancelará su licencia de aplicación de acuerdo con los resultados de su resolución o adoptará otras restricciones en virtud de los acuerdos aplicables.
    • 2) GE imagine eliminará directamente la información emitida por el usuario durante el uso del software bajo licencia que incumpla la legislación, infrinja otros derechos legales o incumpla el Acuerdo.
    • 3) Si un tercero sufriera daños derivados del incumplimiento por parte del usuario de las normas de aplicación, el usuario asumirá de forma independiente la responsabilidad legal en su nombre y protegerá e indemnizará a GE imagine frente a pérdidas o gastos adicionales derivados del mismo. En caso contrario, GE imagine ostenta el derecho de reclamar la indemnización correspondiente.
    • 4) Si GE imagine sufriera cualquier pérdida debido al incumplimiento de la legislación o del Acuerdo por parte del usuario, el usuario indemnizará a GE imagine con respecto a las pérdidas y/o gastos que se deriven.

VI. Norma sobre el contenido de la información

  • 6.1 El usuario se compromete a no realizar ningún acto que incumpla la legislación y a no cometer comportamientos inadecuados mediante el uso del servicio. Estos actos y comportamientos incluyen, aunque sin limitación:
    • 6.1.1 Cargar, transferir o compartir información que incluya alguno de los contenidos que se describen a continuación; contenidos que:
      • 1) Infrinjan los principios fundamentales estipulados en la Constitución.
      • 2) Pongan en peligro la seguridad del estado, revelen secretos de estado, socaven el poder del estado y pongan en peligro la unidad del estado.
      • 3) Perjudiquen el honor y el beneficio del estado.
      • 4) Inciten odio y discriminación nacional y pongan en peligro la unidad del estado.
      • 5) Rompan la política religiosa del estado y promuevan la herejía y la superstición feudal.
      • 6) Propaguen rumores, perturben el orden social y rompan la estabilidad social.
      • 7) Fomenten obscenidad, pornografía, juego, violencia, asesinato y terror o instiguen un crimen.
      • 8) Insulten o calumnien a otras personas o infrinjan los derechos legales e intereses de otras personas.
      • 9) Incluyan contenidos falsos, fraudulentos, amenazantes, que vulneren la privacidad de otras personas, acosadores, delictivos, difamatorios, indecentes o moralmente repulsivos.
      • 10) Incluyan otros contenidos restringidos o prohibidos en virtud de la legislación, normativas, códigos, disposiciones y otras normas legales vigentes.

VII. Política de privacidad y datos

  • 7.1 GE imagine concede la máxima prioridad a la protección de su información personal. GE imagine ha elaborado la Política de privacidad de la GE imagine, en la que se incluyen contenidos relacionados con la titularidad y la protección de la propiedad intelectual, así como con la recopilación, uso, divulgación, almacenamiento y protección, etc. de su información. Se recomienda leer detenidamente la Política de privacidad de la GE imagine.

VIII. Cláusulas de excepción

  • 8.1 A menos que se especifique de otra manera en la legislación y normativas, GE imagine dedicará sus mejores esfuerzos para asegurar la protección, validez, exactitud y fiabilidad del software bajo licencia y las tecnologías e información relacionadas; no obstante, GE imagine no puede garantizarlas plenamente debido a las limitaciones de las tecnologías disponibles actualmente.
  • 8.2 El usuario acepta que GE imagine no asumirá ninguna responsabilidad en relación con pérdidas directas o indirectas derivadas de situaciones de causa mayor y del incumplimiento de un tercero.
  • 8.3 El usuario asumirá la responsabilidad de las lesiones personales o lesiones incidentales o indirectas que se deriven o guarden relación con cualquiera de los siguientes incidentes: 1) Un tercero utiliza el software bajo licencia o cambia sus datos sin permiso; 2) Gastos y pérdidas derivados del uso del software bajo licencia; 3) Error de comprensión del software bajo licencia por parte del usuario; 4) Otras pérdidas relacionadas con el software bajo licencia que se deriven de motivos no atribuibles a GE imagine.
  • 8.4 Cualquier otro software obtenido a partir del software bajo licencia que no haya sido desarrollado y publicado por GE imagine o el desarrollo y publicación de software no autorizado por GE imagine reciben la consideración de software ilegal. La descarga, instalación y uso de este tipo de software puede provocar riesgos impredecibles. GE imagine estará exonerada de las responsabilidades legales y litigios que se deriven de estas actividades y GE imagine ostentará el derecho a suspender o cancelar la licencia de aplicación y/o todos los servicios restantes.
  • 8.5 El usuario ha sido informado de que el uso de la GE imagine y la plataforma inteligente de sus proveedores implica el servicio de Internet, que puede verse afectado por factores inestables en todos los enlaces de comunicación. A pesar de que GE imagine ha adoptado medidas de protección, el servicio puede suspenderse, cancelarse, retrasarse, experimentar restricciones de aplicación o fallos de aplicación derivados de defectos inherentes a Internet y las comunicaciones electrónicas, así como de factores que estén fuera del control razonable de cualquier parte vinculada al Acuerdo (incluyendo, aunque sin limitación, incendio, inundación, ataque terrorista, plaga, desastres naturales, disturbio, virus terminal, ataque de hacker, fallo de red y fallo terminal). Por la presente, el usuario acepta asumir los riesgos indicados anteriormente y reconoce que GE imagine estará exonerada de cualquier responsabilidad cuando el funcionamiento normal de los servicios se vea afectado por los riesgos indicados anteriormente.

IX. Cancelación del Acuerdo e incumplimiento del Acuerdo

  • 9.1 El usuario debe comprender que utilizará el software bajo licencia de conformidad con el ámbito de autorización, respetará la propiedad intelectual del software y los contenidos que se incluyen en el software y desempeñará sus obligaciones de conformidad con el Acuerdo cuando utilice los servicios de GE imagine. GE imagine cancelará la licencia de aplicación si el usuario incurre en un incumplimiento material del Acuerdo.
  • 9.2 La aplicación que haga del software se basa en servicios de soporte suministrados por empresas relacionadas con GE imagine. El incumplimiento por parte del usuario de términos, acuerdos, normas, notificaciones y otras normativas relevantes de GE imagine y de sus empresas relacionadas puede provocar un incumplimiento del uso normal del software bajo licencia; en tal caso, GE imagine podrá ejercer su derecho a cancelar la licencia de aplicación, o adoptar medidas para restringir su licencia de aplicación u otros derechos e intereses controlados por GE imagine que se estipulen en el Acuerdo, incluyendo la suspensión o cancelación de su licencia de aplicación.
  • 9.3 En caso de incumplimiento por parte del usuario del Acuerdo o de otros acuerdos firmados con GE imagine, GE imagine tendrá derecho a informar a las empresas relacionadas para requerir que adopten medidas restrictivas con respecto a sus derechos e intereses, incluyendo la solicitud a las empresas correspondiente para que suspendan o cancelen total o parcialmente los servicios que proporcionen al usuario, y anuncien su incumplimiento del acuerdo en los sitos web que estas empresas exploten o controlen de forma efectiva.
  • 9.4 El software bajo licencia se descarga desde la plataforma de descarga y el usuario deberá acatar las disposiciones de la plataforma de descarga, de la plataforma del sistema y del fabricante del terminal en relación con las alternativas de aplicación y las restricciones del software bajo licencia. Si el tercero mencionado anteriormente confirmara que el usuario ha incumplido o incumple el Acuerdo y se requiriera la intervención de GE imagine, GE imagine podrá cancelar su licencia de aplicación a petición del tercero.
  • 9.5 En caso de cancelación de la licencia de aplicación, el usuario deberá interrumpir el uso del software bajo licencia y destruir todas las copias.
  • 9.6 El usuario debe asumir todas las responsabilidades de indemnización si GE imagine y otros usuarios sufren pérdidas derivadas de su incumplimiento de los términos que se estipulan en el Acuerdo.

X. Legislación vigente y divisibilidad

  • 10.1 La vigencia, interpretación, modificación, ejecución y resolución de litigios del Acuerdo están sometidas a la legislación de la República Popular China. Si no existiera ninguna legislación y normativa disponible, se hará referencia a las prácticas empresariales internacionales y/o a las prácticas industriales.
  • 10.2 El usuario y GE imagine pueden resolver los litigios que se deriven del Acuerdo o que guarden relación con el Acuerdo a través de una negociación amistosa o presentarse ante el arbitraje del Tribunal del Pueblo del Brightlite Nominees P/L trading as Beacon Lighing, donde se suscribe el Acuerdo.
  • 10.3 Cuando el Tribunal del Pueblo decida que cualquier término del Acuerdo no es válido, esta decisión no influirá en la vigencia de otros términos o de cualquier parte de los mismos, y el usuario y GE imagine cumplirán los términos válidos de buena fe.
  • 10.4 El Acuerdo se firma en el Brightlite Nominees P/L trading as Beacon Lighing.

III. Portée du Service

  • 3.1 GE imagine vous accorde le droit d’utiliser le produit basé sur ce logiciel.
  • 3.2 Vous n'avez pas le droit de licencier, vendre, louer, transférer, publier le produit sous une forme quelconque, ni d’utiliser le produit pour d’autres buts commerciaux. 3.2 Du fait des limitations d'adaptation du logiciel sur les plateformes et terminaux, vous ne pouvez utiliser le logiciel licencié que sur la plateforme système et le terminal autorisés ; si vous installez le logiciel licencié sur un autre équipement terminal, cela peut endommager vos fonctions matérielles ou logicielles.

En cas de brèche de sécurité sur votre compte (notamment, sans limitation, la divulgation du mot de passe utilisateur), vous devrez notifier GE imagine immédiatement, et GE imagine vous aidera à prendre des mesures pertinentes. Autrement, tous les comportements liés à votre compte seront assumés par vous-même et vous en endosserez toutes les responsabilités.

IV. Tiers

  • 4.1 Vous reconnaissez que certains services de GE imagine sont basés sur le logiciel ou sur des services fournis par un tiers. Ce service est défini pour faciliter votre application et l’autorisation légale nécessaire est obtenue auprès du tiers.
  • 4.2 Le produit inclut certaines informations et services de tiers. GE imagine ne contrôle ni ne supporte la responsabilité des informations et services de tiers.
  • 4.3 Vous reconnaissez que GE imagine ne peut garantir que le logiciel licencié utilise ou contient lesdits services, ou que d’autres logiciel fournis par le même tiers seront utilisés dans le futur. De même, GE imagine peut utiliser des services similaires fournis par un autre tiers. Dès leur mise en application, le logiciel ou les services correspondants susmentionnés sont soumis au présent Contrat.

V. Norme d'application du Service

  • 5.1 Vous devrez utiliser le logiciel licencié d'une manière normale. Les actions suivantes constituent des violations de l’utilisation normale de l’application :
    • 1) Publier ou partager des virus informatiques, vers, codes malfaisants ou un logiciel qui endommage ou modifie le système ou les données de l’ordinateur délibérément ;
    • 2) Collecter des informations ou des données d'autres utilisateurs sans autorisation, par exemple, l’adresse e-mail et autres informations similaires ;
    • 3) Utiliser de façon malfaisante le produit d’une manière automatique, causant une surcharge du serveur, ou interférer avec ou endommager le serveur web et les liens réseau sous d’autres formes ;
    • 4) Tenter de consulter les données du serveur ou les données de communication du produit sans autorisation ;
    • 5) Interférer avec ou endommager l'application de production par d'autres utilisateur.
  • 5.2 Vous comprenez et convenez que :
    • 1) GE imagine déterminera si vous êtes impliqué ou non dans des violations des normes ci-dessus, et suspendra ou résiliera votre licence d’application selon les résultats de l'évaluation ou prendra d’autres mesures restrictives selon les contrats.
    • 2) GE imagine supprimera directement les informations violant les lois, ou violant d’autres droits légaux, ou en violation du Contrat publié par vous lors de votre utilisation du logiciel licencié.
    • 3) Si un tiers souffre de dommages dus à votre violation de normes de l’application, vous supporterez indépendamment la responsabilité légale en votre nom, et protégerez et indemniserez GE imagine des pertes ou dépenses supplémentaires générées par ceux-ci. Autrement, GE imagine aura le droit de réclamer une compensation.
    • 4) Si GE imagine souffre d’une perte due à votre violation des lois applicables ou du Contrat, vous devrez indemniser GE imagine pour les pertes et (ou) les dépenses générées par ladite violation.

VI. Norme de contenu des informations

  • 6.1 Vous promettez que vous n'accomplirez aucun acte en violation des lois ou comportements inappropriés en utilisant le service, lesdits actes et comportements incluent (sans limitation) :
    • 6.1.1 Le chargement, transfert ou partage d’informations contenant l’un des contenus suivants :
      • 1) Opposition aux principes déterminés dans la Constitution ;
      • 2) Mise en danger de la sécurité, révélation d’un secret d’état, subversion du pouvoir de l’état et cellule de sabotage de l’état ;
      • 3) Dommages à l’honneur et au bénéfice de l'État ;
      • 4) Inciter à la haine nationale et à la discrimination et sabotage de l’unité nationale ;
      • 5) Destruction de la politique religieuse de l'État et promotion d’hérésie et de superstition féodale ;
      • 6) La promotion de rumeurs, déranger l’ordre social et destruction de la stabilité sociale ;
      • 7) La publication d'obscénités, d’images porno, de jeux d’argent, de violence, de meurtre et de terreur ou complicité d’un crime ;
      • 8) Insultes ou calomnies d’autres et violation de droits et d’intérêts légaux d’autres ;
      • 9) Publication de contenus comportant subterfuges, fraudes, dommages, menaces, violation de la vie privée d’autres individus, harcèlement, calomnie, grossièretés, indécence ou contenus moralement répréhensibles ;
      • 10) Publication d’autres contenus restreints ou interdits par les lois, réglementations, règles, dispositions applicables et d’autres normes légales.

VII. Politique de confidentialité et données personnelles

  • 7.1 Il est capital pour GE imagine de protéger vos données. GE imagine a rédigé la Politique de confidentialité de GE imagine, dans laquelle les contenus liés à la propriété et la protection de la propriété intellectuelle, la collecte, l’utilisation, le partage, le stockage et la protection, etc. de vos informations sont exposés. Vous êtes invité à lire entièrement la Politique de confidentialité de GE imagine.

VIII. Clauses d’exception

  • 8.1 À moins que cela ne soit indiqué autrement dans les lois et réglementations, GE imagine s'efforcera au mieux d’assurer la sécurité, la validité, l’exactitude et la fiabilité du logiciel licencié et des technologies et informations impliquées, mais GE imagine ne peut garantir cela du fait des restrictions par les technologies disponibles de nos jours.
  • 8.2 Vous comprenez que GE imagine n’assumera aucune responsabilité pour des pertes directes ou indirectes causées par force majeure ou le défaut d’un tiers.
  • 8.3 Vous serez responsable des blessures du personnel ou de blessures collatérales ou accessoires causées par/liées à l’un des accidents suivants : 1) Un tiers utilise le logiciel licencié ou modifie vos données sans permission ; 2) Les dépenses et pertes produites à cause de l’utilisation du logiciel licencié ; 3) Votre mauvaise compréhension du logiciel licencié ; 4) D’autres pertes liées au logiciel licencié causées par des motifs non imputables à GE imagine.
  • 8.4 Tout autre logiciel licencié-logiciel dérivé non développé et publié par GE imagine ou dont le développement et la publication ne sont pas autorisés par GE imagine est un logiciel illégal. Le téléchargement, l’installation et l’utilisation dudit logiciel peut causer des risques imprévisibles. GE imagine sera dégagé de toute responsabilité légale et litige générés en ce cas et GE imagine aura le droit de suspendre ou résilier la licence de l'application et/ou tout autre services.
  • 8.5 Vous avez été informé du fait que l’utilisation de GE imagine et la plateforme intelligente de son fournisseur implique un service Internet, qui peut être affecté par des facteurs d’instabilité dans tous les liens. Bien que GE imagine ait pris des mesures de protection, le service peut être suspendu, interrompu, retardé, subir des restrictions de l'application ou des échecs de l'application dus aux défaillances inhérentes d’Internet et des e-communications de même que de facteurs au-delà du contrôle raisonnable de toute partie au Contrat (notamment, sans limitations, du fait d'un incendie, d’une inondation, d’une attaque terroriste, de pestilence, de désastres naturels, d’émeutes, d’un virus terminal, d’un piratage, d’une défaillance de réseau et d’une défaillance de terminal). Vous convenez par la présente de supporter les risques susmentionnés et convenez que GE imagine est dégagé de toute responsabilité lorsque l'exécution normale des services est influencée par la survenue des risques susmentionnés.

IX. Résiliation du Contrat et violation du Contrat

  • 9.1 Vous devez comprendre que vous devrez utiliser le logiciel licencié selon la portée de l’autorisation, respecter la propriété intellectuelle du logiciel et des contenus incorporés dans le logiciel, et vous acquitter de vos obligations selon le Contrat lorsque vous utilisez les services de GE imagine. GE imagine résiliera la licence de l'application si vous êtes en violation du Contrat.
  • 9.2 Votre application du logiciel repose sur des services d’appui fournis par des sociétés liées de GE imagine. Les violations des conditions, accords, règles, annonces et autres réglementations pertinentes de GE imagine et ses sociétés liées peut causer une défaillance lors d’un usage normal du logiciel licencié, auquel cas, GE imagine aura le droit de résilier la licence de l’application, ou de prendre des mesures pour restreindre votre licence d’application ou d 'autres droits et intérêts contrôlés par GE imagine comme convenu dans le Contrat, notamment la suspension ou la résiliation de la licence de votre application.
  • 9.3 En cas de violation du Contrat de votre part ou d'autres contrats signés avec GE imagine, la société GE imagine aura le droit de notifier les sociétés liées, en leur demandant de prendre des mesures restrictives quant à vos droits et intérêts, y compris en demandant aux sociétés liées de suspendre ou résilier une partie de la fourniture ou l'ensemble des services pour vous, et d’annoncer légalement votre violation du contrat sur les sites web gérés ou de contrôlés de fait par elle.
  • 9.4 Le logiciel licencié est téléchargé depuis la plateforme de téléchargement et vous devez respecter les stipulations de la plateforme de téléchargement, de la plateforme système et du fabricant du terminal sur les directives et restrictions du logiciel licencié. Si le tiers susmentionné confirme que vous êtes en violation du Contrat et qu'un traitement par GE imagine est requis, GE imagine peut résilier la licence de votre application à la demande du tiers.
  • 9.5 Lorsque la licence de l'application prend fin, vous devez arrêter d’utiliser le logiciel licencié et détruire toutes les copies.
  • 9.6 Vous devrez supporter toutes les responsabilités pour les dommages si GE imagine et d'autres subissent des pertes causées par votre violation des termes du Contrat.

X. Lois applicables et divisibilité du Contrat

  • 10.1 L'applicabilité, l’interprétation, les modifications, l’exécution et le règlement des litiges relatifs au Contrat sont régis par les lois de la République populaire de Chine. Si aucune loi et réglementation n’existe, il sera fait référence aux pratiques commerciales internationales générales et(ou) aux pratiques industrielles.
  • 10.2 Les litiges survenant en lien avec le Contrat peuvent être réglés entre vous et GE imagine par une négociation à l’amiable ou soumis pour jugement à la Cour populaire de Brightlite Nominees P/L trading as Beacon Lighing où le Contrat est signé.
  • 10.3 Lorsque l’une des dispositions du Contrat est jugée non valide par la Cour populaire, cela n'influencera pas la validité d’autres dispositions ou d’une partie de ceux-ci, et vous et GE imagine exécuterez les termes valides de bonne foi.
  • 10.4 Le Contrat est signé à Brightlite Nominees P/L trading as Beacon Lighing.

サービス契約（以下「本契約」という。）は、お客様とGE imagineが署名を行います。GE imagineのプライバシーポリシーや、他のコンテンツを含みます（が、これに限定されません）。変更が生じた場合、GE imagineはそれ以上の通知をせずに、その変更を公式サイトで公表します。発表が行われると、変更された契約およびルールは、お客様の同意を得ることなく、自動的に本契約の一部となります。そのような変更に異議があった場合は、GE imagineのサービスを停止してください；それを使用し続けている場合、変更されたルールに対して異議を唱えておらず、それらに従うことに同意しているとみなされます。



I. 用語の定義

  • 1.1 ライセンスソフトウェアとは、GE imagineが開発し、プラットフォームからダウンロードして、特定のシステムのモバイル端末にインストールし適用するソフトウェアシステムを指します。
  • 1.2 サービスとは、GE imagineがお客様に提供するサービスを指します。ライセンスソフトウェアを使用してモバイル端末上でそのようなサービスを使用することができます。

II. サービス

  • 2.1 GE imagineは、GE imagineコントロールを通じてGE imagineクラウドプラットフォームのインテリジェント端末にアクセスし、インテリジェント機器間の相互リンクを実現する、インテリジェント生活機器管理サービスを提供します。サービス内容には、インテリジェント機器管理、シーン連動、分析レポートなどがあります。ユーザーの要求の変化やサービス提供者の判断に応じてこれら機能は最適化や変更が可能であり、定期または不定期のメンテナンスにより、サービスの供給が中断することがあります。

III. サービスの範囲

  • 3.1 GE imagineは、このソフトウェアに基づいて製品を使用する権利をお客様に付与します。
  • 3.2 お客様は、ライセンス、販売、リース、譲渡、様々な形態においての本製品の支給、その他の商業目的で、本製品を使用することは禁じられています。3.2 ソフトウェア適合プラットフォームおよび端末の制限により、許可されたソフトウェアは許可されたシステムプラットフォームおよび端末でしか使用できません；ライセンスソフトウェアを他の端末装置にインストールすると、ハードウェアまたはソフトウェアの機能が損なわれる可能性があります。
  • 3.3 使用許諾されたソフトウェアは非商用目的でのみ使用でき、ライセンスソフトウェアのインストール、アプリケーションおよび実行は禁止されています。このような商業運営が必要な場合はGE imagineから、事前の書面による承認と許可を得なければなりません。
  • 3.4 GE imagineは時として、ライセンスソフトウェアまたは関連機能を変更、アップグレードまたは移転することができ、ライセンスソフトウェアシステムに新しい機能またはサービスを追加することができます。上記の新しい機能またはサービスに別途の契約が付随していない場合、お客様は対応する機能およびサービスを受ける資格があり、これは本契約の対象となります。
  • 3.5 入力データの正確性、信頼性、完全性、合法性、およびデータの入手方法の合法性については、お客様が責任を負い、データと情報を定期的にバックアップするものとします。お客様は、そのような情報の損傷および紛失のリスクをすべて負うものとします。
  • 3.6 アカウント番号とパスワードを正しく保管しなければなりません。アカウントの安全性の抜け穴（ユーザーパスワードの漏洩を含むがこれに限定されません）が発生した場合、GE imagineに時間内に通知し、GE imagineは関連する措置を講じます。それ以外の場合は、アカウントに関連するすべての行動はお客様が引き受け、お客様はすべての責任を負います。

IV. 第三者

  • 4.1 お客様は、GE imagineの特定のサービスが、第三者が提供するソフトウェアまたはサービスに基づいていることを認めます。そのようなサービスは申請を簡単にするために設定され、第三者から必要な法的許可が得られます。
  • 4.2 本製品には、第三者の特定の情報およびサービスが含まれています。GE imagineは、第三者の情報およびサービスに対してコントロールせず、責任も負いません。
  • 4.3 お客様は、ライセンスソフトウェアが常にそのようなサービスを使用または包含していること、または同じ第三者によって提供される他のソフトウェアが、将来使用されることをGE imagineが保証するものではないことを認識します。同様に、第三者が提供する同様のサービスを使用することがあります。申し込みの際は、前述の対応するソフトウェアまたはサービスが本契約の対象となります。

V. サービスアプリケーションの標準

  • 5.1 通常の方法でライセンスソフトウェアを使用するものとします。アプリケーションの標準に違反しているのは以下のとおりです：
    • 1）コンピューターシステムやデータを故意に毀損または変更するコンピューターウイルス、ワーム、悪意のあるコードまたはソフトウェアを発行または共有すること；
    • 2）例えば、Eメールアドレスなどの情報または他のユーザーの情報を、許可なしに収集すること；
    • 3）自動的に製品を悪意のある形で使用して、サーバーへの負荷を高めたり、他の形式のWebサーバーやネットワークリンクを妨害したり破損したりすること；
    • 4）製品のサーバーデータまたは通信データを無許可で利用しようとする；
    • 5）他のユーザーによる生産アプリケーションの妨害または破損すること。
  • 5.2 お客様は、以下の内容を理解し同意するものとします：
    • 1）GE imagineは、お客様が上記の基準違反に関与しているかどうかを判断し、最終結果に応じてアプリケーションライセンスを一時停止または終了させるか、契約に従ってその他の制限を設けます。
    • 2）GE imagineは、法律に違反したり、他人の法的権利を侵害したり、ライセンスソフトウェアを使用する際にお客様から発行された契約に違反したりしている場合に、情報を直接削除します。
    • 3）申請基準の違反により第三者が被害を受けた場合は、お客様の名前で法的責任を独立して負うとともに、そこから発生した損失または追加費用からGE imagineを守り補償するものとします。それ以外の場合、GE imagineは補償を請求する権利を有します。
    • 4）GE imagineが関連する法律または本契約の違反に起因する損失を被った場合、お客様は損失およびそれに起因する費用をGE imagineに補償するものとします。

VI. 情報コンテンツの標準

  • 6.1 サービスを利用して法律や不適切な行為に違反する行為をしないことを約束します。そのような行為には以下の行為が含まれます（これに限定されません）：
    • 6.1.1 以下の内容の1つを含む情報のアップロード、転送、または共有：
      • 1）憲法で定められた基本原則に反対すること；
      • 2）国家の安全を危うくし、国家の秘密を開示し、国家権力を破壊し、国家統一権を妨害すること；
      • 3）国家の名誉と利益を損なうこと；
      • 4）国家の憎悪と差別を引き起こし、国家統一を妨害すること；
      • 5）国家の宗教政策を破棄し、邪教と封建的な迷信を提唱すること；
      • 6）デマを広げ、社会秩序を乱し、社会の安定を破壊すること；
      • 7）わいせつ行為、ポルノ、ギャンブル、暴力、殺人、恐怖、犯罪を広めること；
      • 8）他者を侮辱したり誹謗中傷したり、他者の法的権利と利益を侵害すること；
      • 9）詐欺、不正行為、危害、脅迫、他者のプライバシーの侵害、嫌がらせ、侵害、中傷、劣悪、下品、または道徳上反発する内容を含むこと；
      • 10）適用される法律、規則、ルール、その他の法的基準によって制限または禁止されている他の内容を含むこと。

VII. 個人のポリシーとデータ

  • 7.1 GE imagineがお客様の個人情報を保護することは重要です。GE imagineは、GE imagineプライバシーポリシーを作成し、お客様の情報の所有権および知的財産権の保護、収集、使用、共有、保管および保護などに関するコンテンツを開示しております。GE imagineプラットフォームのプライバシーポリシーを徹底的に読むことをお勧めします。

VIII. 例外条項

  • 8.1 GE imagineは、法律で別段の定めがない限り、ライセンスソフトウェア、技術、および情報セキュリティ、妥当性、正確性、信頼性を確保するために最善を尽くしますが、GE imagineは現在利用可能な技術の制限により、同じことを保証することができません。
  • 8.2 GE imagineは、不可抗力および第三者の不履行による直接的または間接的な損失に対して責任を負いません。
  • 8.3 お客様は、以下の事故のいずれかに起因する人身傷害または偶発的または間接的な損傷に責任を負うものとします：1）第三者がライセンスソフトウェアを使用するか、許可なくデータを変更するとき； 2）ライセンスソフトウェアを使用して発生した費用および損失； 3）ライセンスソフトウェアに対する誤解； 4）GE imagineに起因しない理由によるライセンスソフトウェアに関するその他の損失。
  • 8.4 GE imagineによって開発されず、リリースされていない他のライセンスソフトウェアから派生したソフトウェアは、GE imagineによって許可されていないもので、違法なソフトウェアとなります。このようなソフトウェアをダウンロード、インストール、使用すると、予期しないリスクが発生する可能性があります。GE imagineはそのリスクにより発生した法的責任と紛争を負いません。また、GE imagineはアプリケーションライセンスおよび/またはその他のすべてのサービスを一時停止または終了する権利を有するものとします。
  • 8.5 GE imagineおよび、会社のサプライヤーのスマートプラットフォームの使用にはインターネットサービスが含まれており、あらゆるリンクにおける不安定な要素の影響を受ける可能性があります。GE imagineは保障措置を講じていますが、本サービスは、インターネットおよび電子通信の本質的な欠陥ならびに本契約の当事者の合理的な管理を超えた要因により、アプリケーションの制限またはアプリケーションの障害によって中断、中止、延期される可能性があります（火災、洪水、テロ攻撃、疫病、自然災害、暴動、ターミナルウィルス、ハッカー攻撃、ネットワーク障害、ターミナル障害を含みますが、これに限定されません）。上記のリスクを負うことに同意し、通常のサービスの実行が前述のリスクの影響を受けた場合、GE imagineはいかなる責任からも免責されることに同意するものとします。

IX. 契約解除と契約違反

  • 9.1 お客様は、GE imagineのサービスを使用する場合、ライセンスソフトウェアを使用許諾範囲に従って使用し、ソフトウェアに含まれるソフトウェアおよびコンテンツの知的財産権を尊重し、本契約に従って義務を履行しなければならないことを理解する必要があります。GE imagineは、本契約の重大な違反に該当する場合は、アプリケーションライセンスを終了します。
  • 9.2 お客様のソフトウェアの使用は、GE imagineの関連会社によって提供されるサポートサービスに依存します。GE imagineおよびその関連会社の条項、合意、規則、告知およびその他の関連規則を違反すると、ライセンスされたソフトウェアの通常の使用に障害が発生する可能性があります。その場合、GE imagineはアプリケーションライセンスの停止または終了を含む、GE imagineが管理するアプリケーションライセンスまたはその他の権利と利益を、契約の合意どおりに制限する措置を取る権利を有します。
  • 9.3 GE imagineとの契約またはその他の合意内容に違反が生じた場合、GE imagineは関係会社に対し、サービスの一部または全部の提供を中止または終了させることを含む、お客様の権利と利益に対する制限的措置の実施要求を関連会社に通知し、 実際にGE imagine社が管理するウェブサイト上でお客様の合意違反を法的に告知する権利を有します。
  • 9.4 ライセンスソフトウェアは、ダウンロードプラットフォームからダウンロードされ、ライセンスソフトウェアの適用方法および制限について、ダウンロードプラットフォーム、システムプラットフォームおよび端末製造の規定を遵守しなければなりません。上記の第三者が、あなたが契約違反であることを確認し、GE imagineの対処が必要な場合、GE imagineは第三者の要求により、アプリケーションライセンスを終了させることができます。
  • 9.5 アプリケーションのライセンスが終了すると、ライセンスソフトウェアの使用を停止し、すべてのコピーを破棄しなければなりません。
  • 9.6 GE imagineおよびその他のユーザーが本契約の条件違反に起因する損失を被った場合は、お客様はすべての補償責任を負う必要があります。

X. 準拠法および法における分離

  • 10.1 本契約の有効性、説明、変更、執行および紛争解決は、中華人民共和国の法律の対象となります。関連する法律や規制が利用できない場合は、一般的な国際的ビジネス慣行および（または）業界慣行を、参照しなければなりません。
  • 10.2 本合意に起因する、または本合意に関連して生じる紛争は、お客様とGE imagineによって、友好的な交渉によって解決されるか、または同合意が締結のために署名されたBrightlite Nominees P/L trading as Beacon Lighingに提出されます。
  • 10.3 本契約のいずれかの期間が人民裁判所によって無効と判断された場合、それは他の条件またはその一部の有効性に影響を及ぼさず、お客様とGE imagineは有効な条件を誠実に実行するものとします。
  • 10.4 本契約は、Brightlite Nominees P/L trading as Beacon Lighingで署名されています。

I. 용어의 정의

  • 1.1 라이선스가 부여된 소프트웨어는 플랫폼에서 다운로드하여 특정 시스템 모바일 단말기에 설치 및 적용되는 GE imagine에서 개발한 소프트웨어 시스템을 말합니다.
  • 1.2 서비스는 GE imagine(주)가 귀하에게 제공하는 서비스를 의미합니다. 귀하는 라이선스가 부여된 소프트웨어로 모바일 단말기에서 이러한 서비스를 사용할 수 있습니다.

II. 서비스

  • 2.1 GE imagine는 GE imagine 컨트롤을 통해 GE imagine 및 공급사의 스마트 플랫폼의 지능형 단말기에 귀하가 접근할 수 있게 하는 지능형 생활 장비 관리 서비스를 제공하며, 지능형 장비 간의 상호 연결을 실현합니다. 서비스 내용은 지능형 장비 관리, 장면 연동 및 분석 보고서 등을 포함합니다. 이러한 기능들은 사용자의 요구 사항 변경이나 서비스 공급 업체 판단에 따라 최적화 또는 수정될 수 있으며, 정기 및 비정기 유지 보수로 인해 서비스 공급이 일시 중단될 수 있습니다.

III. 서비스 범위

  • 3.1 GE imagine는 이러한 소프트웨어를 기반으로 제품을 사용할 권리를 귀하에게 부여합니다.
  • 3.2 귀하는 어떠한 형태로든 제품의 라이선스를 부여하거나, 제품을 판매, 임대, 양도, 배포하거나, 또는 기타의 상업적 목적으로 사용하는 것이 금지됩니다. 3.2 소프트웨어 적응형 플랫폼 및 단말기의 제약으로 인해, 귀하는 오직 승인된 시스템 플랫폼 및 단말기에서만 라이선스가 부여된 소프트웨어를 사용할 수 있습니다. 귀하가 라이선스가 부여된 소프트웨어를 다른 단말기 장비에 설치하는 경우, 귀하의 하드웨어나 소프트웨어의 기능에 손상을 줄 수 있습니다.
  • 3.3 귀하는 라이선스가 부여된 소프트웨어가 비상업적 목적으로만 사용될 수 있으며, 라이선스가 부여된 소프트웨어의 설치, 적용 및 실행이 금지됨을 인정합니다. 그러한 상업적 운영이 필요한 경우, GE imagine의 사전 서면 승인 및 허가를 받아야 합니다.
  • 3.4 GE imagine는 라이선스가 부여된 소프트웨어 또는 관련 기능을 수시로 변경, 업그레이드 또는 양도할 수 있으며, 또한 라이선스가 부여된 소프트웨어 시스템에 새로운 기능이나 서비스를 추가할 수 있습니다. 전술한 새로운 기능 또는 서비스가 별도의 약정을 수반하지 않는 경우, 귀하는 본 약정의 적용을 받는 해당 기능 및 서비스를 이용할 수 있습니다.
  • 3.5 귀하는 입력 데이터의 정확성, 신뢰성, 무결성과 적법성 및 귀하가 데이터를 얻는 방법의 적법성에 대해 책임을 지며, 또한 데이터 및 정보를 수시로 백업해야 합니다. 귀하는 그러한 정보의 손상 및 손실에 대한 모든 위험을 부담해야 합니다.
  • 3.6 귀하는 귀하의 계정 번호와 비밀번호를 올바르게 보관해야 합니다. 귀하의 계정에 대한 안전상의 허점(사용자 암호 누출을 포함하되 이에 한정되지 않음)이 있는 경우, 귀하는 GE imagine에 즉시 통지해야 하며, GE imagine는 귀하에게 관련 조치를 취할 수 있도록 도울 것입니다. 그렇게 하지 않은 경우, 귀하의 계정과 관련된 모든 행동은 귀하가 부담해야 하며, 귀하가 모든 책임을 지게 됩니다.

IV. 제3자

  • 4.1 귀하는 GE imagine의 특정 서비스가 제3자가 제공한 소프트웨어나 서비스를 기반으로 한다는 것을 인정합니다. 이러한 서비스는 귀하의 앱이 원활하게 작동하도록 설정되며, 또한 제3자로부터 필요한 법적 승인을 얻습니다.
  • 4.2 제품에는 제3자의 특정 정보와 서비스가 포함됩니다. GE imagine는 제3자의 정보 및 서비스에 대한 책임을 관리하거나 부담하지 않습니다.
  • 4.3 귀하는 GE imagine가 라이선스가 부여된 소프트웨어가 항상 그러한 서비스를 사용하거나 포함한다는 것을 보장할 수 없으며, 또한 향후 동일한 제3자가 제공하는 다른 소프트웨어가 사용될 것이라고 보증하지 않는 것을 인정합니다. 마찬가지로 GE imagine는 다른 제3자가 제공한 유사한 서비스를 사용할 수도 있습니다. 신청 시, 위에 언급된 해당 소프트웨어나 서비스는 본 약정의 적용을 받습니다.

V. 서비스 신청 기준

  • 5.1 귀하는 라이선스가 부여된 소프트웨어를 정상적인 방법으로 사용해야 합니다. 다음과 같은 방법들은 신청 기준에 위반됩니다:
    • 1) 컴퓨터 시스템이나 데이터를 고의적으로 손상시키거나 변경하는 컴퓨터 바이러스, 웜, 악성 코드 또는 소프트웨어를 배포하거나 공유하는 행위
    • 2) 승인을 받지 않고 다른 사용자의 정보나 데이터(예: 이메일 주소 등)를 수집하는 행위
    • 3) 제품을 악의적으로 사용하여 자동으로 서버에 과부하가 걸리게 하거나, 또는 기타 형태로 웹 서버 및 네트워크 링크를 방해하거나 손상시키는 행위
    • 4) 승인을 받지 않고, 제품의 서버 데이터나 통신 데이터에 접근하려고 시도하는 행위
    • 5) 다른 사용자의 제작 앱을 방해하거나 손상시키는 행위
  • 5.2 귀하는 다음 사항을 이해하고 이에 동의합니다:
    • 1) GE imagine는 귀하가 위의 기준을 위반했는지 여부를 판단하고, 결정 결과에 따라 귀하의 앱 라이선스를 일시 중지 또는 종료하거나, 약정에 따라 기타 제한 조치를 취합니다.
    • 2) 라이선스가 부여된 소프트웨어를 사용할 때 귀하가 제공한 정보가 법률에 위배되거나 타인의 법적 권리를 침해하거나, 또는 본 약정을 위반하는 경우, GE imagine는 이를 직접 삭제합니다.
    • 3) 귀하의 신청 기준 위반으로 인해 제3자가 손해를 입은 경우, 귀하는 귀하의 이름으로 법적 책임을 독자적으로 부담해야 하며, 또한 그로부터 발생한 손실이나 추가 비용에 대해 GE imagine를 보호하고 면책해야 합니다. 그렇지 않은 경우, GE imagine는 보상을 청구할 권리를 가집니다.
    • 4) 귀하의 관련 법률 또는 약정 위반으로 인해 GE imagine가 손실을 입은 경우, 귀하는 그로부터 발생한 손실이나 비용에 대해 GE imagine에 보상해야 합니다.

VI. 정보 내용의 기준

  • 6.1 귀하는 서비스를 이용함으로써 법률 위반 행위나 부적절한 행동을 하지 않을 것을 약속합니다. 그러한 행위나 행동에는 다음이 포함됩니다(이에 한정되지 않음):
    • 6.1.1 다음 내용 중 하나를 포함하는 정보를 업로드, 전송 또는 공유하는 행위:
      • 1) 헌법에서 정한 기본 원칙에 배치되는 내용
      • 2) 국가의 안전을 위협하고, 국가 기밀을 공개하며, 국가 권력을 전복시키고, 국가 통일성을 파괴하는 내용
      • 3) 국가의 명예와 이익을 손상시키는 내용
      • 4) 민족적 증오심과 차별을 야기하고 국가 통일성을 파괴하는 행위
      • 5) 국가의 종교 정책을 파괴하고 이단과 봉건적인 미신을 옹호하는 내용
      • 6) 소문을 유포하고 사회 질서를 어지럽히며 사회 안정을 파괴하는 내용
      • 7) 음란물, 포르노, 도박, 폭력, 살인 및 테러를 확산시키거나 또는 범죄를 조장하는 내용
      • 8) 타인을 모욕하거나 비방하고 타인의 법적 권리와 이익을 침해하는 내용;
      • 9) 사기, 기만, 해악, 위협, 타인의 사생활 침해, 괴롭힘, 침해, 중상 모략, 천박함, 외설을 포함하는 내용, 또는 도덕적으로 혐오적인 내용
      • 10) 해당 법률, 규정, 규칙, 조항 및 기타의 법적 기준에 의해 제한되거나 금지된 내용.

VII. 개인 정보 보호 방침 및 데이터

  • 7.1 GE imagine가 귀하의 개인 정보를 보호하는 것은 매우 중요합니다. GE imagine는 지적 재산의 소유 및 보호, 귀하의 정보의 수집, 사용, 공유, 저장, 보관 및 보호 등과 관련된 내용이 공개되는 GE imagine의 개인 정보 보호 방침을 수립하고 있습니다. GE imagine의 개인 정보 보호 방침을 꼼꼼히 읽으시기 바랍니다.

VIII. 예외 조항

  • 8.1 법률 및 규정에 달리 명시되어 있지 않는 한, GE imagine는 라이선스가 부여된 소프트웨어와 기술 및 정보의 보안, 유효성, 정확성 및 신뢰성을 보장하기 위해 최선을 다할 것입니다. 그러나 GE imagine는 현재 사용 가능한 기술의 제한으로 인해 이를 보장할 수는 없습니다.
  • 8.2 귀하는 불가항력 및 제3자의 불이행으로 인해 야기된 직접 또는 간접적 손실에 대해 GE imagine가 책임을 지지 않음을 이해합니다.
  • 8.3 귀하는 다음과 같은 사고로 인해 또는 그와 관련하여 초래된 신체 부상 또는 부수적 또는 간접적인 부상에 대해 책임이 있습니다: 1) 제3자가 라이선스가 부여된 소프트웨어를 사용하거나 허가없이 귀하의 데이터를 변경하는 경우 2) 라이선스가 부여된 소프트웨어를 사용함으로써 발생한 비용 및 손실 3) 라이선스가 부여된 소프트웨어에 대한 귀하의 오해 4) 라이선스가 부여된 소프트웨어와 관련된 기타의 손실로서 GE imagine의 귀책 사유로 초래된 것이 아닌 경우.
  • 8.4 기타 라이선스가 부여된 소프트웨어에서 파생된 것으로, GE imagine가 개발 및 배포하지 않은 소프트웨어, 또는 개발 및 배포를 GE imagine가 승인하지 않은 불법 소프트웨어. 이러한 소프트웨어를 다운로드, 설치 및 사용하는 경우, 예기치 않은 위험이 발생할 수 있습니다. GE imagine는 그로 인해 발생하는 법적인 책임 및 분쟁으로부터 자유로우며, 또한 GE imagine는 앱 라이선스 및/또는 기타 모든 서비스를 일시 중지 또는 종료하는 권리를 가집니다.
  • 8.5 GE imagine 및 공급사의 스마트 플랫폼의 사용이 인터넷 서비스에 관련되어 있으며, 이는 모든 링크에서의 불안정한 요소들에 의해 영향을 받을 수 있음을 GE imagine는 귀하에게 이미 알렸습니다. GE imagine가 안전 보호 조치를 취했음에도 불구하고, 서비스는 인터넷 및 전자 통신의 고유 결함 및 본 약정 당사자들의 합리적인 통제를 벗어나는 요인(화재, 홍수, 테러 공격, 전염병, 자연 재해, 폭동, 단말기 바이러스, 해커 공격, 네트워크 오류 및 단말기 고장 등을 포함하며, 이에 한정되지 않음)에 의해 서비스가 일지 중지, 종료, 지연되거나, 앱 제한 또는 앱 이상을 겪을 수도 있습니다. 귀하는 전술한 위험들을 귀하가 부담하는 것에 동의하며, 또한 전술한 위험의 발생으로 인해 정상적인 서비스 운영이 영향을 받을 경우, GE imagine는 어떠한 책임도 지지 않는 것에 귀하는 동의합니다.

IX. 약정 해지 및 약정 위반

  • 9.1 귀하는 GE imagine의 서비스를 이용할 경우, 라이선스가 부여된 소프트웨어를 승인된 범위에 따라 사용하고, 소프트웨어의 지적 재산 및 소프트웨어에 포함된 내용을 존중하며, 또한 본 약정에 따른 의무를 이행해야 함을 이해해야 합니다. GE imagine는 귀하가 약정을 중대하게 위반하는 경우, 앱 라이선스를 해지합니다.
  • 9.2 귀하의 소프트웨어 적용은 GE imagine의 관련 회사가 제공하는 지원 서비스에 의존합니다. GE imagine 및 관련 회사의 약관, 약정, 규칙, 선언 및 기타의 관련 규정을 위반할 경우, 라이선스가 부여된 소프트웨어를 정상적으로 사용하지 못할 수도 있으며, 이러한 경우 GE imagine는 앱 라이선스를 해지하거나, 귀하의 앱 라이선스 또는 본 약정에서 합의한 바에 따라 GE imagine가 관리하는 기타의 권리 및 이익을 제한하는 조치를 취할 수 있으며, 이에는 귀하의 앱 라이선스의 일시 중지나 해지 등이 포함됩니다.
  • 9.3 귀하가 GE imagine와 체결한 약정 또는 기타 약정을 위반하는 경우, GE imagine는 관련 회사에 통지하여 관련 회사가 귀하에게 제공하는 서비스의 전부 또는 일부를 일시 중지 또는 해지하도록 요청하는 것을 포함하여 관련 회사가 귀하의 권리 및 이익에 대한 제한 조치를 취할 것을 요구하고, 또한 관련 회사가 운영하거나 실질적으로 관리하는 웹 사이트에 귀하의 약정 위반을 합법적으로 공표하는 권리를 가집니다.
  • 9.4 라이선스가 부여된 소프트웨어는 다운로드 플랫폼에서 다운로드되며, 귀하는 라이선스가 부여된 소프트웨어의 적용 방법 및 제한 사항들에 대해 다운로드 플랫폼, 시스템 플랫폼 및 단말기 제조업체의 규정들을 준수해야 합니다. 위에서 언급한 제3자가 귀하가 약정을 위반한 것을 확인하고 GE imagine가 이를 처리하는 것이 요구되는 경우, GE imagine는 제3자의 요청에 따라 귀하의 앱 라이선스를 해지할 수 있습니다.
  • 9.5 앱 라이선스가 해지되는 경우, 귀하는 라이선스가 부여된 소프트웨어의 사용을 중단하고 모든 사본을 파기해야 합니다.
  • 9.6 GE imagine 및 기타 사용자가 귀하의 약정 위반으로 인해 손실을 입은 경우, 귀하는 모든 보상 책임을 져야 합니다.

X. 준거법 및 가분성

  • 10.1 본 약정의 유효성, 설명, 변경, 체결 및 분쟁 해결은 중화 인민 공화국의 법률의 적용을 받습니다. 관련 법률 및 규정이 없는 경우, 일반적인 국제 비즈니스 관행 및 업계 관행을 참조합니다.
  • 10.2 본 약정으로부터, 또는 그와 관련하여 발생하는 모든 분쟁은 우호적인 협상을 통해 귀하와 GE imagine간에 해결되거나, 또는 본 약정이 체결된 Brightlite Nominees P/L trading as Beacon Lighing 인민 법원에 제출되어 판결을 받을 수 있습니다.
  • 10.3 본 약정의 어떠한 조항이 인민 법원에 의해 무효인 것으로 판결이 내려지는 경우, 이는 나머지 다른 조항이나 그 일부의 유효성에 영향을 미치지 않으며, 귀하와 GE imagine는 유효한 조항들을 성실히 이행해야 합니다.
  • 10.4 본 약정은 Brightlite Nominees P/L trading as Beacon Lighing에서 체결되었습니다.

Antes de aceitar o Contrato, deve ler atentamente todo o conteúdo do Contrato e conhecer plenamente seus termos, especialmente cláusulas restritivas ou excepções. Cláusulas restritivas ou excepções estão em negrito ou destacadas em outras formas para chamar sua atenção. Em caso de qualquer dúvida sobre os termos do Contrato, entre em contacto com o departamento comercial relevante da GE imagine. Não tem permissão para usar o serviço antes de ter lido e aceito todos os termos do Contrato, acordos e regras relevantes, etc. Depois de selecionar “Concordo e envio o Contrato” (consulte a página de registo para obter mais detalhes) e conclua o procedimento de registo, ou utiliza o serviço em qualquer forma, será considerado que leu e concordou com a restrição do Contrato e as regras acima. Em caso de qualquer violação do Contrato, a GE imagine tem o direito de restringir, suspender ou encerrar unilateralmente o serviço para si e tem o direito de investigar suas responsabilidades relevantes.

Deve assinar o Contrato de Serviço (doravante referido como “o Contrato”) e pela GE imagine (doravante denominada "GE imagine"). Inclui (mas não se limita a) Política de Privacidade da GE imagine e outros conteúdos. Em caso de mudança, a GE imagine anunciará tal alteração em seu site oficial sem mais notificação. I. Definições de termos

  • 1.1 Software licenciado refere-se ao sistema de software desenvolvido pela GE imagine, baixado da plataforma e instalado e aplicado em terminais móveis do sistema especificado.
  • 1.2 Serviços referem-se aos serviços fornecidos por si pela GE imagine Pode usar esses serviços no terminal móvel com o software licenciado.

II. Serviço

  • 2.1 A GE imagine oferece serviços de gerenciamento de equipamentos de vida inteligente, com base nos quais pode acessar o terminal inteligente através da GE imagine e a plataforma inteligente dos seus fornecedores através do GE imagine Control, e realizar interligações entre equipamentos inteligentes. O conteúdo do serviço inclui gerenciamento inteligente de equipamentos, interligação de cena e relatório de análise, etc. Tais funções podem ser otimizadas ou modificadas de acordo com as mudanças das demandas ou julgamentos do fornecedor de serviços, e o fornecimento de serviços pode ser suspenso devido a manutenção regular e irregular.

III Abrangência do serviço

  • 3.1 A GE imagine lhe concede o direito de usar o produto com base neste software.
  • 3.2 Está proibido de licenciar, vender, arrendar, transferir, emitir o produto em qualquer forma ou usar o produto para outra finalidade comercial. 3.2 Devido a limitações na plataforma de adaptação de software e terminais, só pode usar o software licenciado na plataforma e no terminal do sistema autorizado; Se instalar o software licenciado em outro equipamento terminal, isso poderá danificar sua função de hardware ou software.
  • 3.3 Reconhece que o software licenciado só pode ser usado para fins não comerciais e a instalação, aplicação e execução do software licenciado é proibida. Se tal operação comercial for necessária, autorização prévia por escrito e permissão da GE imagine serão obtidas.
  • 3.4 A GE imagine pode alterar, atualizar ou transferir o software licenciado ou funções relevantes de tempos em tempos, e pode adicionar novas funções ou serviços no sistema de software licenciado. Se nenhum acordo separado for acompanhado das mencionadas novas funções ou serviços, terá direito às funções e serviços correspondentes, que também estão sujeitos ao Contrato.
  • 3.5 Será responsável pela exatidão, confiabilidade, integridade e legalidade dos dados de entrada e pela legalidade do modo como obtém os dados, e fará backup de dados e informações de tempos em tempos. Deve arcar com todos os riscos de danos e perda de tais informações.
  • 3.6 Deve manter seu número de conta e palavra-passe de forma apropriada.   • 4.1 Reconhece que determinado serviço da GE imagine é baseado em software ou serviços fornecidos por terceiros. Esse serviço é definido para facilitar sua inscrição e a autorização legal necessária é obtida do terceiro.
  • 4.2 O produto inclui certas informações e serviços do terceiro. A GE imagine não controla nem assume responsabilidade pelas informações e serviços do terceiro.
  • 4.3 Reconhece que a GE imagine não pode garantir que o software licenciado sempre use ou contenha tais serviços, ou que outro software fornecido pelo mesmo terceiro seja usado no futuro. Da mesma forma, pode usar serviços semelhantes fornecidos por terceiros. Após a inscrição, o software ou serviços correspondentes estão sujeitos a este Contrato.

V. Norma de aplicação do serviço

  • 5.1 Deverá usar o software licenciado de maneira normal. As maneiras a seguir estão a violar normas de aplicação:
    • 1) Emitir ou partilhar vírus de computador, worms, códigos maliciosos ou software que deliberadamente danifique ou altere o sistema ou os dados do computador;
    • 2) Coletar informações ou dados de outros utilizadores sem autorização, por exemplo, endereço de e-mail e similares;
    • 3) Utilizar o produto maliciosamente de maneira automática, a causar sobrecarga no servidor ou a interferir ou danificar o servidor da web e os links de rede em outros formas.
    • 4) Tentativa de visitar dados do servidor ou dados de comunicação do produto sem autorização;
    • 5) Interferir ou prejudicar a aplicação de produção por outros utilizadores.
  • 5.2 Entende e concorda que:
    • 1) A GE imagine determinará se está ou não envolvido na violação das normas acima, e suspende ou encerra sua licença de aplicação de acordo com os resultados da determinação ou toma outras restrições de acordo com os contratos.
    • 2) A GE imagine excluirá diretamente as informações que violam as leis, ou infringem os direitos legais de terceiros, ou violam o Contrato emitido por si ao usar o software licenciado.
    • 3) Se um terceiro sofrer danos devido a sua violação das normas do aplicativo, deverá, independentemente, assumir responsabilidade legal em seu nome, e proteger e indenizar a GE imagine de perdas ou despesas adicionais geradas a partir dela. Caso contrário, a GE imagine tem o direito de reclamar uma indemnização.
    • 4) Se a GE imagine sofrer qualquer perda devido à sua violação das leis relevantes ou do Contrato, deverá compensar a GE imagine por perdas e (ou) despesas geradas a partir dela.

VI. Norma de conteúdo da informação

  • 6.1 Promete que não irá realizar qualquer ato em violação das leis ou comportamentos impróprios ao utilizar o serviço, tal ato e comportamento incluem (mas não limitado a):
    • 6.1.1 Upload, transferência ou partilhamento de informações a conter um dos seguintes conteúdos:
      • 1) Oposição aos princípios básicos determinados na Constituição;
      • 2) Pôr em risco a segurança do Estado, revelar segredo de Estado, subverter o poder do Estado e sabotar a unidade do Estado;
      • 3) Causar danos à honra e benefício do Estado;
      • 4) Incitar ódio e discriminação nacional e sabotar a unidade nacional;
      • 5) Destruir a política religiosa do Estado e defender a heresia e a superstição feudalista;
      • 6) Espalhar rumores, perturbar a ordem social e destruir a estabilidade social;
      • 7) Disseminar obscenidade, pornografia, jogos de azar, violência, assassinato e terror ou instigar um crime;
      • 8) insultar ou difamar os outros e infringir os direitos e interesses legais de terceiros;
      • 9) Conter conteúdo de fraude, defraudação, dano, ameaça, violação à privacidade de outros, assédio, infração, calúnia, grosseria, indecência ou conteúdo moralmente repulsivo;
      • 10) Conter outros conteúdos restritos ou proibidos pelas leis, regulamentos, regras, disposições e outras normas legais aplicáveis.

VII. Política e dados privados

  • 7.1 É crucial que a GE imagine proteja suas informações pessoais. A GE imagine prepara a Política de Privacidade da GE imagine, na qual os conteúdos relacionados à propriedade e proteção da propriedade intelectual, coleta, uso, partilhamento, armazenamento e proteção, etc. de suas informações são divulgados. Sugerimos que leia completamente a Política de Privacidade da GE imagine.

VIII. Cláusulas de excepção

  • 8.1 A menos que seja especificado o contrário em leis e regulamentos, a GE imagine fará o melhor para garantir a segurança, validade, precisão e confiabilidade do software licenciado e tecnologias e informações envolvidas, mas a GE imagine não pode garantir o mesmo devido à restrição das tecnologias disponíveis atualmente.
  • 8.2 Entende que a GE imagine não assumirá responsabilidade por perdas diretas ou indiretas causadas por força maior e por inadimplência de terceiros.
  • 8.3 Será responsável por danos pessoais ou incidentais ou indiretamente causados por ou relacionados a um dos seguintes acidentes: 1) Um terceiro usa o software licenciado ou altera seus dados sem permissão; 2) Despesas e perdas produzidas pelo uso do software licenciado; 3) Seu mal entendimento do software licenciado; 4) Outras perdas relacionadas a software licenciado causadas por motivos não atribuíveis à GE imagine.
  • 8.4 Qualquer outro software derivado de software licenciado não desenvolvido e lançado pela GE imagine ou o desenvolvimento e lançamento não serem concedidos pela GE imagine é um software ilegal. Baixar, instalar e usar esse software pode causar riscos imprevisíveis. A GE imagine estará livre de responsabilidades legais e disputas geradas nele e a GE imagine terá o direito de suspender ou encerrar a licença de inscrição e/ou outros serviços.
  • 8.5 Foi informado de que o uso da GE imagine e a plataforma inteligente dos seus fornecedores envolve serviços de Internet, que podem ser afetados por factores instáveis em todos os links. Embora a GE imagine tenha adotado medidas de salvaguarda, o serviço pode ser suspenso, encerrado, adiado, sofrer com a restrição de aplicativos ou falha do aplicativo devido a defeitos inerentes à Internet e à comunicação eletrónica, além de factores além do controlo razoável de qualquer parte do Contrato (incluindo mas não limitado a incêndio, inundação, ataque terrorista, pestilência, desastres naturais, tumulto, vírus terminal, ataque de hackers, falha de rede e falha terminal). Concorda em renunciar a riscos e concorda que a GE imagine está livre de qualquer responsabilidade quando a execução normal dos serviços é influenciada pela ocorrência de riscos precedentes.

IX. Rescisão do contrato e violação do contrato

  • 9.1 Deve compreender que deverá usar o software licenciado de acordo com o escopo de autorização, respeitar a propriedade intelectual do software e o conteúdo contido no software e executar as obrigações de acordo com o Contrato ao usar os serviços da GE imagine. A GE imagine terminará a licença do aplicativo se estiver em violação material do Contrato.
  • 9.2 Sua aplicação do software depende dos serviços de suporte fornecidos pelas empresas relacionadas da GE imagine. A violação de termos, acordos, regras, anúncios e outras regulamentações relevantes da GE imagine e de suas empresas relacionadas pode causar falha no uso normal do software licenciado; nesse caso, a GE imagine terá o direito de rescindir a licença do aplicativo ou tomar medidas para restringir sua solicitação, licença ou outros direitos e interesses controlados pela GE imagine, conforme acordado no Contrato, incluindo suspensão ou cancelamento da sua licença de inscrição.
  • 9.3 No caso de violação do Contrato ou de outros acordos assinados com a GE imagine, a GE imagine terá o direito de notificar as empresas relacionadas, exigir que elas tomem medidas restritivas aos seus direitos e interesses, inclusive exigir que as empresas relacionadas suspendam ou parem de suprir parte ou serviços inteiros para si, e legalmente anunciar sua quebra de contrato em sites executados ou realmente controlados por eles.
  • 9.4 O software licenciado é baixado da plataforma de download e deve obedecer as estipulações da plataforma de download, da plataforma do sistema e da fabricação do terminal nas formas de aplicação e restrições do software licenciado. Se o terceiro mencionado acima confirmar que está a violar o contrato e o tratamento da GE imagine for necessário, a GE imagine poderá rescindir sua licença do aplicativo a pedido de terceiros.
  • 9.5 Quando a licença do aplicativo terminar, deverá parar de usar o software licenciado e destruir todas as cópias.
  • 9.6 Deve assumir todas as responsabilidades de compensação se a GE imagine e outros utilizadores sofrerem perdas causadas por sua violação dos termos do Contrato.

X. Leis governativas e divisibilidade

  • 10.1 A eficácia, explicação, mudança, execução e solução de controvérsias do Contrato estão sujeitas às leis da República Popular da China. Se não houver leis e regulamentações relevantes, referências a práticas comerciais internacionais gerais e (ou) práticas industriais devem ser feitas.
  • 10.2 A disputa decorrente ou em conexão com o Contrato pode ser resolvida por si e pela GE imagine através de uma negociação amigável ou submetida ao Tribunal Popular do Brightlite Nominees P/L trading as Beacon Lighing, onde o Contrato é assinado para adjudicação.
  • 10.3 Quando qualquer termo do Contrato for considerado inválido pelo Tribunal Popular, ele não influenciará a eficácia de outros termos ou de qualquer parte dele, e a GE imagine deverá executar os termos válidos em boa fé.
  • 10.4 O Contrato é assinado no Brightlite Nominees P/L trading as Beacon Lighing.

Приветствуем вас на платформе GE imagine!

Прежде чем принять Соглашение, внимательно ознакомьтесь с его содержанием и убедитесь в том, что вам понятны все его условия, в частности, положения об ограничениях и исключениях. Положения об ограничениях и исключениях выделены жирным шрифтом или иным способом, чтобы привлечь ваше внимание. В случае возникновения вопросов, связанных с условиями Соглашения, обратитесь в соответствующий отдел компании GE imagine. Вам не разрешается пользоваться услугой, до того как вы прочтете и примете все условия Соглашения, а также связанных с ним соглашений, правил и т. д. Если вы нажмете кнопку Agree and submit the Agreement (Принять и отправить Соглашение) (точную формулировку см. на странице регистрации) и завершите процедуру регистрации или воспользуетесь услугой каким-либо иным образом, тем самым вы подтвердите, что прочли и приняли предусмотренные Соглашением ограничения и вышеупомянутые правила. В случае нарушения Соглашения GE imagine имеет право в одностороннем порядке ограничить, приостановить или прекратить оказание вам услуги, а также провести расследование в отношении ваших соответствующих обязательств.

Настоящее Соглашение об оказании услуг (далее — «Соглашение») подписывается между вами и компанией GE imagine (далее — «GE imagine»). Оно включает в себя, помимо прочего, Политику конфиденциальности GE imagine и другие документы. В случае внесения изменений в эти документы GE imagine объявит о них на своем официальном сайте без каких-либо дополнительных уведомлений. После такого объявления измененное соглашение и правила автоматически становятся неотъемлемой частью Соглашения без каких-либо дополнительных уведомлений с запросом вашего согласия. Если вы возражаете против таких изменений, прекратите использовать услугу компании GE imagine; продолжая использовать услугу, вы подтверждаете, что не возражаете против измененных правил и обязуетесь их соблюдать.



I. Термины и определения

  • 1.1. «Лицензионное программное обеспечение» означает систему программного обеспечения, разработанную компанией GE imagine, доступную для загрузки с платформы, а также установки и использования на мобильных терминалах с указанной системой.
  • 1.2. «Услуги» означают услуги, оказываемые вам компанией GE imagine Вы можете использовать эти услуги на мобильном терминале с лицензионным программным обеспечением.

II. Услуга

  • 2.1. Компания GE imagine предлагает вам услуги управления «интеллектуальным» оборудованием, благодаря которым вы получаете доступ к интеллектуальному терминалу на базе облачной платформы GE imagine и смарт-платформы ее поставщика через инструмент управления GE imagine Control и можете организовать связь между интеллектуальными устройствами. В состав услуги входит управление интеллектуальным оборудованием, установление связи между объектами, аналитический отчет и т. д. Эти функции можно оптимизировать и модифицировать в соответствии с изменениями в потребностях пользователей или решениями поставщика услуг, а сама услуга может быть временно недоступна в связи с плановыми и внеплановыми техническими работами.

III. Объем услуг

  • 3.1. Компания GE imagine предоставляет вам право использовать продукт, разработанный на основе данного программного обеспечения.
  • 3.2. Вам запрещается лицензировать, продавать, сдавать в аренду, передавать, публиковать продукт в какой бы то ни было форме или использовать его в прочих коммерческих целях.
  • 3.3. В связи с ограничениями, связанными с адаптацией программного обеспечения на терминалах и платформах, вы можете использовать лицензионное программное обеспечение только на разрешенной системной платформе и терминале; установка лицензионного программного обеспечения на другом оборудовании может привести к повреждению вашего аппаратного или программного обеспечения.
  • 3.4. Вы признаете, что лицензионное программное обеспечение может использоваться исключительно в целях, не связанных с получением прибыли, и что лицензионное программное обеспечение запрещается устанавливать, применять и запускать. Если необходимо коммерческое использование, вы должны предварительно получить соответствующее письменное согласие и разрешение компании GE imagine.
  • 3.5. Компания GE imagine имеет право периодически менять, обновлять или передавать другим лицам лицензионное программное обеспечение или его функции, а также добавлять новые функции или службы в систему лицензионного программного обеспечения. Если внедрение вышеупомянутых новых функций или услуг не сопровождается подписанием отдельных соглашений, вы имеете право пользоваться такими функциями и услугами, которые также будут подпадать под действие Соглашения.
  • 3.6. Вы несете ответственность за точность, достоверность, целостность и законность вводимых данных, а также за законность способа их получения и за регулярное резервное копирование данных и информации. Вы берете на себя все риски повреждения и утери такой информации.
  • 3.7. Вы обязуетесь надлежащим образом хранить номер и пароль своей учетной записи. В случае нарушения безопасности вашей учетной записи (включая, помимо прочего, разглашение пароля пользователя) вы обязуетесь своевременно уведомить компанию GE imagine, которая поможет вам принять необходимые меры. В противном случае все действия, совершенные от имени вашей учетной записи, считаются вашими действиями, и вы несете всю ответственность за них

IV. Третье лицо

  • 4.1. Вы признаете, что услуга компании GE imagine основана на программном обеспечении или услугах, предоставляемых третьим лицом. Такая услуга предоставляется в помощь пользователю, и предусмотренное законом разрешение третьего лица было получено.
  • 4.2. Продукт включает в себя определенные сведения и услуги, предоставляемые третьим лицом. Компания GE imagine не контролирует информацию и услуги, предоставляемые третьим лицом, и не несет за них никакой ответственности.
  • 4.3. Вы признаете, что компания GE imagine не может гарантировать, что лицензионное программное обеспечение всегда будет использовать или содержать такие услуги или что другое программное обеспечение, предоставляемое тем же третьим лицом, будет использоваться в будущем. Компания также может использовать похожие услуги, предоставляемые другим третьим лицом. В случае применения вышеуказанного программного обеспечения или услуг они подпадают под действие Соглашения.

V. Правила пользования услугой

  • 5.1. Вы обязуетесь использовать лицензионное программное обеспечение в стандартном порядке. Следующие действия являются нарушением правил использования:
    • 1) загрузка или распространение компьютерных вирусов, программ-«червей», вредоносного кода или программного обеспечения в целях умышленного повреждения или изменения компьютерных систем или данных;
    • 2) несанкционированный сбор информации или данных других пользователей, например адресов электронной почты и т. д.;
    • 3) использование продукта в преступных целях с применением автоматических средств, перегрузка сервера, вмешательство в работу или повреждение веб-сервера и сетевых подключений иным образом;
    • 4) попытка осуществить несанкционированный доступ к данным сервера или передаваемым данным продукта;
    • 5) вмешательство в процесс использования продукта другими пользователями или создание препятствий для использования продукта другими пользователями.
  • 5.2. Вы понимаете и соглашаетесь с тем, что:
    • 1) компания GE imagine устанавливает факт вашей причастности или непричастности к вышеперечисленным нарушениям правил и, исходя из сделанного заключения, принимает решение о временной блокировке или аннулировании вашей лицензии на использование либо о введении других ограничений, предусмотренных соглашениями;
    • 2) компания GE imagine немедленно удаляет информацию, загруженную вами при использовании лицензионного программного обеспечения, если такая информация противоречит требованиям законов, ущемляет законные права третьих лиц или нарушает Соглашение;
    • 3) в случае причинения ущерба третьему лицу в результате нарушения вами правил использования вы единолично несете предусмотренную законом ответственность и ограждаете компанию GE imagine от ответственности за убытки или дополнительные расходы, вызванные такими нарушениями. В противном случае компания GE imagine имеет право взыскать компенсацию;
    • 4) если компания GE imagine понесет какие-либо убытки в результате нарушения вами требований действующего законодательства или Соглашения, вы обязуетесь возместить компании убытки и (или) расходы, вызванные такими нарушениями.

VI. Правила, касающиеся содержания информации

  • 6.1. Вы обязуетесь не осуществлять никаких действий, нарушающих закон, и не допускать неприемлемого поведения посредством использования услуги. К таким действиям и поведению относятся, помимо прочего:
    • 6.1.1. загрузка, передача или распространение информации, которая:
      • 1) противоречит основополагающим принципам Конституции;
      • 2) представляет угрозу государственной безопасности, способствует раскрытию государственной тайны, подрывает власть государства и разрушает целостность государства;
      • 3) причиняет ущерб национальной репутации и государственным интересам;
      • 4) разжигает ненависть и дискриминацию по национальному признаку и подрывает сплоченность нации;
      • 5) противоречит государственной политике в отношении религии и пропагандирует еретические учения и феодальные суеверия;
      • 6) распространяет слухи, подрывает общественный порядок и социальную стабильность;
      • 7) способствует пропаганде непристойного поведения, порнографии, азартных игр, насилия, убийства и терроризма или подстрекает к совершению преступлений;
      • 8) содержит оскорбления или клевету в адрес третьих лиц и нарушает их законные права и интересы;
      • 9) содержит фальсифицированные, ложные, причиняющие ущерб сведения и угрозы; нарушает права третьих лиц на неприкосновенность частной жизни; включает материалы, направленные на притеснение или нарушение прав, а также клеветнические, оскорбительные, непристойные или неприемлемые в нравственном отношении материалы;
      • 10) включает другие материалы, распространение которых ограничено или запрещено действующими законами, нормативно-правовыми актами, правилами, положениями и прочими правовыми стандартами.

VII. Политика конфиденциальности и данные

  • 7.1. Компания GE imagine со всей ответственностью относится к защите ваших персональных данных. Она разработала Политику конфиденциальности для платформы GE imagine, охватывающую такие вопросы, как права интеллектуальной собственности и их защита, сбор, использование, передача, хранение, защита и т. д. вашей информации. Предполагается, что вы внимательно прочли Политику конфиденциальности для платформы GE imagine.

VIII. Положения об исключениях

  • 8.1. Если иное не установлено законами и нормативными положениями, компания GE imagine примет все возможные меры, чтобы обеспечить безопасность, законность, точность и надежность лицензионного программного обеспечения, а также связанных с ним технологий и информации, но компания GE imagine не может гарантировать этого в силу ограничений, свойственных доступным на сегодняшний день технологиям.
  • 8.2. Вы признаете, что компания GE imagine не принимает на себя ответственности за фактические или косвенные убытки, вызванные обстоятельствами непреодолимой силы и неисполнением обязательств третьими лицами.
  • 8.3. Вы несете ответственность за причинение вреда здоровью персонала, а также за случайное или косвенное причинение вреда здоровью в результате любого из следующих инцидентов: 1) несанкционированное использование лицензионного программного обеспечения или изменение ваших данных третьим лицом; 2) расходы и убытки, понесенные в результате использования лицензионного программного обеспечения; 3) неправильное понимание вами лицензионного программного обеспечения; 4) прочие убытки, связанные с лицензионным программным обеспечением и обусловленные причинами, не зависящими от компании GE imagine.
  • 8.4. Любое другое лицензионное программное обеспечение, т. е. производное программное обеспечение, которое не было разработано и выпущено компанией GE imagine либо на разработку и выпуск которого компания GE imagine не давала своего разрешения, является незаконным программным обеспечением. Загрузка, установка и использование такого программного обеспечения могут быть связаны с непредсказуемыми рисками. Компания GE imagine освобождается от ответственности в случае споров, связанных с таким программным обеспечением, и имеет право временно заблокировать или отозвать лицензию на использование и (или) прекратить оказание всех остальных услуг.
  • 8.5. Вы проинформированы о том, что платформа GE imagine и смарт-платформы ее поставщика представляет собой интернет-услугу, на качество которой могут влиять факторы нестабильного подключения. Несмотря на то что компания GE imagine приняла меры безопасности, оказание услуги может быть приостановлено или прекращено, отсрочено, ухудшено в связи с ограничением или невозможностью ее использования в результате внутренних сбоев в работе сети Интернет и электронной связи, а также факторами, не зависящими от воли сторон Соглашения (включая, помимо прочего, пожары, наводнения, террористические акты, эпидемии, стихийные бедствия, восстания, вирусные заражения терминалов, хакерские атаки, сбои в работе сети и терминалов). Настоящим вы признаете вышеуказанные риски и соглашаетесь с тем, что компания GE imagine освобождается от любой ответственности в тех ситуациях, когда перечисленные риски влияют на нормальное функционирование услуг.

IX. Расторжение Соглашения. Нарушение Соглашения

  • 9.1. Вы признаете, что, пользуясь услугами компании GE imagine, вы должны использовать лицензионное программное обеспечение в строго разрешенном объеме, а также соблюдать права интеллектуальной собственности на программное обеспечение и его содержимое и исполнять обязательства, предусмотренные Соглашением. Если вы допускаете существенное нарушение Соглашения, компания GE imagine отзывает лицензию на использование.
  • 9.2. Использование вами программного обеспечения зависит от вспомогательных услуг, оказываемых компаниями, связанными с GE imagine. Нарушение условий, соглашений, правил, требований уведомлений и прочих соответствующих нормативных положений компании GE imagine и связанных с ней компаний может привести к сбою в обычном процессе использования лицензионного программного обеспечения, и в этом случае компания GE imagine имеет право отозвать лицензию на использование или принять меры для ограничения вашей лицензии или других прав и интересов, контролируемых компанией GE imagine, как указано в Соглашении, в том числе в форме временной блокировки или отзыва вашей лицензии на использование.
  • 9.3. В случае нарушения вами Соглашения или других соглашений с компанией GE imagine она имеет право сообщить об этом связанным с ней компаниям и потребовать, чтобы они приняли меры по ограничению ваших прав и интересов, в том числе приостановили или прекратили оказание вам всех или части услуг, и на законных основаниях сообщили о допущенном вами нарушении соглашения на веб-сайтах, которыми они управляют или которые фактически контролируют.
  • 9.4. Загрузка лицензионного программного обеспечения осуществляется с платформы загрузки, и вы обязуетесь соблюдать правила, установленные этой платформой, системной платформой и изготовителем терминала в отношении способов использования, а также ограничения, связанные с лицензионным программным обеспечением. Если вышеупомянутое третье лицо подтвердит, что вы нарушили соглашение, и это потребует действий со стороны компании GE imagine, она может отозвать вашу лицензию на использование по запросу этого третьего лица.
  • 9.5. После прекращения действия лицензии на использование вы обязуетесь прекратить использование лицензионного программного обеспечения и уничтожить все его экземпляры.
  • 9.6. Вы обязаны возместить компании GE imagine и другим пользователям все убытки, понесенные ими в результате нарушения вами условий Соглашения.

X. Применимое законодательство и автономность положений

  • 10.1. Вопросы действительности, толкования, изменения, исполнения Соглашения и рассмотрения связанных с ним споров регулируются законодательством Китайской Народной Республики. При отсутствии соответствующих законов и нормативных положений стороны обращаются к общепринятым международным коммерческим и (или) отраслевым практикам.
  • 10.2. Спор, вытекающий из Соглашения или связанный с ним, может быть урегулирован в рамках добросовестных переговоров между вами и компанией GE imagine или передан на рассмотрение в народный суд округа Brightlite Nominees P/L trading as Beacon Lighing, в котором было подписано Соглашение.
  • 10.3. Если какое-либо из положений Соглашения признается недействительным согласно решению народного суда, это не влияет на действительность других положений или их частей, и вы и компания GE imagine обязуетесь добросовестно исполнять действительные условия.
  • 10.4. Соглашение подписано в округе Brightlite Nominees P/L trading as Beacon Lighing.
